루만은 윤리학에게 도덕에 관한 도덕적 이론이 아니라 좋은/나쁜 혹은 선/악 구별을 ‘하나의’ 구별로 다루는 도덕의 반성이론이 되라고 주문한다. 루만은 윤리학이 그런 반성이론이 될 때 비로소 기능적으로 분화된 사회에서 한편으로 도덕을 대변하면서 다른 한편으로 사회의 요구를 도덕에게 번역해주는 일을 맡을 수 있을 것이라고 여긴다. 루만이 보기에 윤리학의 그러한 변화는 이미 등장했어야 하는 것이다. 하지만 근대사회로의 이행기에 윤리학이 도덕의 정초 문제로 방향을 설정함으로써 사회구조와 의미론 사이의 격차가 벌어지는 일종의 지적 지체현상이 생겨났다. 루만이 보기에 윤리학은 너무 오랫동안 도덕과 자신을 구분하지 못한 채 자신의 사명을 도덕에 근거를 제공하는 것으로 여겼다. 그런 까닭에 윤리학은 사회구조의 변화들에 반응하긴 하면서도 동시에 많은 반성의 가능성들을 놓쳤다. 이 과정을 재구성해서 보여줌으로써 윤리학에게 도덕의 정초이론이 아니라 반성이론이 되라고 촉구하는 것이 윤리학과 관련된 루만의 작업의 핵심이다. 본 논문은 루만의 다층적인 논지를 정확히 살펴보는 것을 주요 목표로 삼는다. 부수적으로 국내의 선행연구들에 대한 비판적 검토를 통해 루만의 주요 논지 가운데 오해된 부분과 제대로 조명되지 않은 부분을 지적할 것이다.
Abstract
N. Luhmann requires ethics not to be a moral theory of morality but a reflective theory of morality, which deals with the distinction between good and bad or between good and evil as a distinction. Only as such a reflective theory can ethics, he claims, represent morality, on the one hand, and translate social demands into moral terms, on the other, in the functionally differentiated society. According to him, such a transformation of ethics should have taken place earlier on. For a long time, however, ethics has not been able to distinguish herself from morality and has regarded her task as giving foundational supports to the moral. Therefore, though responding to changes of the social structure, ethics missed so much chance to reflect on the moral. Reconstructing this process and urging ethics not to be a justificatory theory but to be a reflective theory of morality are the crucial point of Luhmann's arguments related to ethics. The primary aim of this article lies in explaining his extremely multi- layered arguments. However, by way of a critical examination of preceding researches in Korea about his theory of morality, I will point out some hitherto misunderstood and insufficiently illuminated parts of his main arguments.
