경찰의 군사화에 관한 연구 : 미국의 정책분석을 중심으로

미국은 9･11 테러사태를 계기로 자국 내 강력한 감시 및 대응체계를 구축하였다. 미국의 대테러 대응전략은 경찰에게 군사무기를 보급하여 준군사조직으로 변모시킴과 동시에 테러사태에 대한 적극적인 대응을 위해 경찰특공대(SWAT)를 자주 현장에 출동시키는 것이었다. 그런데 시민들은 중무장하고 출동한 경찰특공대에게 위화감을 느끼며 이에 대한 불안감을 표명해왔고, 이를 가리켜 ‘경찰의 군사화(police militarization)’라고 지칭하면서 강도 높은 비판을 하였다. 미국 정부는 경찰의 군사화에 대하여 치안경력의 보호를 위한 단순 방어용이라고 주장하였지만 비판여론에 따라 경찰 군사장비의 사용에 대한 규제를 위해 각각 대통령령 제13684호인 Establishment of the President’s Task Force on 21st Century Policing과 대통령령 제13688호인 Federal Support for Local Law Enforcement Equipment Acquisition을 입법하게 되었다. 우리나라는 미국과 다르게 일선 시위현장에 군사장비로 무장한 경찰특공대 등이 투입되지 않는다. 물론 총기탈취범과 인질극 및 테러범죄 등의 중대한 사건에서는 경찰특공대 등이 총기를 소지하여 대응하지만 시위현장과 일반 수사업무에는 중화기를 소지하고 투입되지 않는다. 그러나 유럽의 주요국에서 이슬람국가(IS)에 의해 크고 작은 테러가 계속 발생하고 있는 가운데 우리나라도 테러안전지대라고 할 수 없다. 그래서 우리나라에서도 경찰의 군사화에 관한 논의가 필요하다. 만일 국내에서 테러사건이 발생한다면 중무장한 경력의 투입이 필요하며, 이는 국민들에게 위화감을 조성할 수 있다. 이 때문에 사전에 경찰의 군사장비의 사용방식과 규제에 대하여 논의할 필요가 있으며, 국민들의 의견의 수렴이 필요하다고 판단된다. 나아가 경찰의 군사장비 조달에 관한 법령의 정비가 필요하며 보급되는 무기의 종류에 대해서도 법령정비가 필요하다고 생각한다.
Abstract
After the 9･11 terrorist attacks occurred in the United States, the United States built a system to deal with extremely strong terrorism in the United States. The strategy of terrorism in the United States supplemented the police with military weapons and changed it to a military organization. And the police special commandant frequently dispatched to the demo site. However, the citizen felt a sense of incompatibility with the police special commandant who launched heavily and armed and mentioned the sense of uneasiness about this. The fact that fear is felt from police officers armed with citizens as such is regarded as the militarization of the police. The US government insisted that the militarization of the police was a means to protect the police. However, based on criticism of the people legislated the Executive Order 13684 and Executive Order 13688. Korea has not been dispatched to police force military armed with military equipment on the demonstration site. However, in Europe terrorism has occurred in IS, so Korea cannot be a terrorist safe area as well. Therefore, even in South Korea, discussion on the militarization of the police is necessary. If terrorist incidents occurred in Korea it is necessary to introduce a heavily armed police which can create discomfort for the people. For this reason, it is necessary to discuss police military equipment usage and regulation in advance.
