경찰의 대테러 정보수집 발전방안에 관한 연구: 국가정보기관과의 비교연구를 중심으로

911테러 이후 선진국들이 내놓은 정책의 공통점은 테러 예방을 위해 정보가 관건임을 절감하고, 테러와 관련된 모든 기관들을 동원하여 정보 수집을 강화하고 이를 적극적으로 공유한다는 점이다. 또 한 가지 특징은 미국의 연방수사국, 영국의 런던 수도경찰청, 독일의 연방범죄수사청 등과 같이 경찰기관이 국가정보기관과 함께 주도적으로 테러정보를 수집하고 있다는 점이다. 그러나, 우리나라는「테러방지법」에서 국가정보원장을 테러정보의 수집 주체로 명시하고 있는데 반해, 경찰에 대해서는 관계기관으로만 규정하고 있다. 이는 경찰이 실질적으로 대테러정보를 수집활동을 하고 있음에도 명시적인 주체로 인정하지 않는 것이며, 이러한 현상이 장기화될 경우 국가차원의 대테러안전망이 약화될 소지가 크다. 따라서 이 연구는 경찰기관과 국가정보기관을 대테러정보의 수집 여건을 중심으로 비교 분석하고, 경찰의 대테러정보 수집 발전방안을 제시하고자 한다. 연구결과는 ① 경찰에게 국가정보기관과 마찬가지로 「테러방지법」상 독자적인 대테러정보활동 주체로서의 권한과 책임을 부여하여 국가대테러 안전망을 강화하고, ② 경찰청장 직속의 대테러관리관ㆍ대테러정보센터를 설치하여 각종의 경찰기관에서 수집한 대테러정보를 분석ㆍ공유하며, ③ 국가정보원 테러정보통합센터를 국무총리실 대테러센터 산하 기구로 재편함으로써 정보공유의 원활을 기하고 유관기관간 공조를 강화해야 한다는 점이다.
Abstract
After the 911 terror, the common feature of the policy which the main advanced countries presented is to feel keenly about the importance of the intelligence on preventing terrors, and to reinforce the collection of the intelligence by mobilizing all the government agencies that are related to the terror and actively sharing the information. Also, another character is that the police department such as the FBI of the US, MPS of Britain, and BKA of Germany plays the lead role in collecting, analyzing, and sharing the terror intelligence together with the intelligence agency. However, in contrast to Korea which states in the 「Anti-Terrorism Legislation」 that the National Intelligence Director is the main agent of the collection, the police is regulated as the ‘Authority having jurisdiction’. This attitude of the law potentially has the possibility of weakening the counterterrorism safety net in the dimension of the state by not recognizing the police as the overt main agent although the police actually collects the counterterrorism intelligence. Therefore, this study compares and analyzes the police department and the national intelligence agency centered on collection conditions of the counterterrorism intelligence, and suggesting the collecting development plan on the counterterrorism intelligence of the police. The result of the study is as the following. 1. Reinforce the safety net of the national counterterrorism by assigning the right and ability to the police as the same as the national intelligence agency as the only main counterterrorism intelligence activity agent of the 「Anti- Terrorism Legislation」, 2. Analyzing and sharing the counterterrorism intelligence which was collected from the police from all over the whole country by installing the counterterrorism manager and the counterterrorism intelligence center that directly belongs to the chief of the national police agency, 3. Reinforcing the cooperation between the related organizations and smoothing up sharing the information by reorganizing the Terrorism Intelligence Integrated Center of the National Intelligence Service into the affiliated organization of the Office of the Prime Minister counterterrorism center.
