공중보건수단에 의한 시민의 자유의 제한에 대해서 (1) 공동체주의와 공리주의는 정당화된다고, (2) 자유지상주의와 확대된 자유지상주의 생명의료윤리는 정당화되지 않는다고, (3) 다원주의적 자유주의와 공동체주의적 자유주의는 조건부로 정당화된다고 주장한다. 필자는 이런 이론들의 변증법적 관계와 각 이론의 장단점을 비판적으로 논하고 개선방향을 제시한다. 필자는 (1) 공동체주의의 문제점을 지적하고 공리주의가 이런 공동체주의의 문제점을 해결할 수 있다고 했지만, 공리주의가 사회정의를 강조했다는 장점에도 불구하고 그 자체로는 적절하게 시민의 자유를 보호하지 못한다고, (2) 자유지상주의의 주요 논리적 근거인 밀의 위해의 원칙에 대한 해석은 자유지상주의들에게 조차도 적절치 않으며, 확대된 자유주의 생명의료윤리의 최고원칙으로 통용되는 자율성 존중은 과대평가되었고, 다른 생명윤리의 원칙들과 부정합적이라고, (3) 다원주의적 자유주의에 관해서는 개인주의적으로 편향되어서 공중보건수단을 충분히 정당화하지 못한다고, 공동체주의적 자유주의는 자유주의와 개인과 공동체의 이익이 조화를 이루는 ’공동체‘의 가치를 결합시키려 하지만 우선 이런 공동체가 실현불가능하고, 전체적인 이론의 정합성에 문제가 있다고 비판했으며, 그런 공동체 대신 자유주의적 공동체 가치로 대체하는 것이 더 적절하다고 논했다.
Abstract
With regard to the public health measures which curtail civil liberties, (1) communitariansim and utilitarianism claim that they are justified (2) libertarianism and expanded liberal biomedical ethics claim that they are not justified (3) pluralist liberalism and (4) communitarian liberalism claim that they are conditionally justified. In this paper, I assess the advantages and disadvantages of theses theories and their dialectical relations, then propose some solutions for improvement. I argue that (1) communitarianism has serious problems, but utiliarianism can solve these problems; utilitarianism emphasizes social justice, however, it cannot properly protect civil liberties (2) the logical basis of libertarianism is its interpretation of Mill’s principle of harm, but that interpretation is not proper even for libertarians; the respect for personal autonomy is virtually taken as ‘supreme’ priinciple of expanded liberal biomedical ethics, but its value is overrated and its combination of other principles flirts with inconsistency (3) pluralist liberalism is tilted for liberal principles so that it cannot properly justify public health measures; (4) communitarian liberalism tries to align liberal justice with substantial community value, but its conception of community is infeasible and then its whole theoretical structure is incoherent. I propose that it is better to replace infeasible community value with liberal community value.
