나는 이 논문에서 시험 문제와 답안의 형식을 빌려 톰 레건의 『동물권 옹호』를 중심으로 그의 동물권 주장을 요약하고 비판적으로 평가하려고 한다. 레건의 동물권을 이해하기 위해서는 그의 핵심 개념들을 이해해야 한다. 그중 1절에서는 본래적 가치와 삶의 주체 개념이 어떻게 도입되는지 설명하겠다. 2절에서는 거기서 존중의 원리와 해악의 원리가 적용되어 동물의 권리가 어떻게 도출되는지 설명하고, 권리들이 충돌할 때 최소 침해의 원리와 상황 악화의 원리로 어떻게 조율하는지 살펴보겠다. 3절과 4절에서는 레건의 주장들을 비판적으로 평가하겠다. 레건의 핵심 개념인 본래적 가치는 모호하고 신비로운 것이라는 비판을 많이 받는다. 나는 그런 비판과 달리 동물의 본래적 가치를 부여하는 것은 받아들일 수 있다고 주장하겠다. 반면에 레건의 주장과 달리 인간과 동물의 본래적 가치가 평등하지 않음을 보이겠다.
Abstract
In this paper, I will argue in the form of an exam, structured with questions and answers, to summarize and critically evaluate Tom Regan’s claims on animal rights, focusing on his The Case for Animal Rights. To understand Regan’s animal rights, we have to understand his core concepts. Among them, Section 1 will explain how the concept of inhrent values and subjects-of-a-life is introduced. In Section 2, I will explain how animal rights are derived by applying the respect principle and the harm principle, and how to coordinate them with the miniride principle and the worse-off principle when the rights conflict. Sections 3 and 4 will critically evaluate Reagan’s arguments. The inherent value, the core concept of Regan, is often criticized as being ambiguous and mysterious. Contrary to such criticism, I would argue that it is acceptable to assign to animals their inherent values. On the other hand, contrary to Regan’s argument, I will show that the inherent values of humans and animals are not equal.
