동물의 권리를 둘러싼 논쟁 -리건(T. Regan)과 코헨(C. Cohen)의 견해를 중심으로-

이 글은 동물의 권리를 둘러싼 찬반논쟁을 살펴보고 있다. 즉 찬성측 대변자로는 리건을, 반대측 대변자로는 코헨을 내세워 그들 각자의 주장을 진단해보고 난 뒤, 논쟁의 쟁점과 그 쟁점에 대한 조정 방안을 모색해보고 있다. 리건은 동물중심주의 입장에서 동물은 삶의 주체로서 내재적 가치를 지니고 있고 따라서 인간과 동등한 권리를 갖는다고 주장한다. 반면에 코헨은 어떤 존재가 권리를 소유하려면 윤리규범의 고안 능력이나 자율성 등이 있어야 함에도 동물에겐 그런 능력이 없기에 권리를 소유할 수 없다고 반박한다. 필자는 동물의 권리를 승인하는 데 찬성하는 입장이다. 그러나 동물의 권리를 인정하는 입장은 논리적 일관성의 문제에 노출된다. 가령 인간과 동물 중 어느 한 쪽의 희생이 불가피한 상황에 놓인다고 했을 때 이 입장은 인간의 생명을 우선적으로 배려하기 때문이다. 동물의 권리를 인정하되 그 권리는 인간과 동등한 권리가 아니라 제한적인 권리일 수밖에 없는 것이다. 이러한 논리적 일관성의 문제를 해결할 수 있는 방안으로 필자는 반성적 평형법을 제안하고 있다.
Abstract
This paper is examining the pros and cons on the animal rights. I selected Tom Regan as a spokeswoman for the consenting party and Carl Cohen as a spokeswoman for the negative side. First, after I reviewed their respective claims, I tried to search for issues of the debate and adjustment measures of them. According to Regan, animals are subjects-of-a-life and have inherent value. He insists that the rights of animals be acknowledged and respected. On the other hand, Cohen is against Regan's argument that animals have rights. He argues that animals cannot be the bearers of rights because the concept of right is essentially human and it is rooted in the human moral world. My position is that animal rights should be recognized. But, its position has granted approval of animal rights is exposed to the problem of logical consistency. If we are faced with a very embarrassing situation that the expense of either side of humans and animals are inevitable, we would save human life first without hesitation. Even though we recognize animal rights, it is not equivalent to human rights. I'd like to suggest a 'reflective equilibrium' in ways to solve this problem of logical consistency.
