Abstract
With recent shifts in South Korea’s policy favoring active support for overseas nuclear power plant (NPP) exports, the importance of research on the related legal and practical issues has become prominent. Exporting nuclear technology requires understanding the fundamental concepts and structures of NPPs and the legal aspects under international Nuclear Law. This law covers four main areas: safety, security, safeguards, and liability. Ensuring safety involves implementing international agreements through domestic laws. Security focuses on protecting radioactive materials, guided by the IAEA’s Convention on the Physical Protection of Nuclear Material. Non-nuclear-weapon states must have Comprehensive Safeguards Agreements (CSA) with the IAEA. The basic principles of nuclear liability are established through the Paris and Vienna Conventions and the Convention on Supplementary Compensation for Nuclear Damage (CSC). The IAEA’s standard nuclear bidding process includes pre-bid preparation, bid document preparation, bid submission, evaluation, contract negotiation, and contract signing. Close cooperation between the governments and industries of the exporting and importing countries is crucial. Clear and precise contract terms, particularly regarding the scope of supply, are essential for mitigating risks. NPP business structures vary by financing methods, risk allocation, and regulatory and market conditions, including EPC contracts, public-private partnerships (PPP), intergovernmental agreements, and the Mankala model. While South Korea’s EPC contract model has advantages, it carries significant construction risks. Alternative business models may be necessary to enhance competitiveness, especially when the importing country has limited financial resources. NPP project risks can be categorized into economic, political, regulatory, project delivery, and safety risks. Economic risks involve the lender’s assessment of financial viability, and it is worth referencing models like the UK’s Contracts for Difference (CfD) and Regulated Asset Base (RAB). Political risks require maintaining good relations with the importing country and incorporating force majeure clauses. Project delivery risks, including supply, design, and construction risks, must be meticulously identified and addressed in contracts to minimize disputes. Adhering to international safety standards and implementing rigorous safety measures are crucial for mitigating safety risks.
