연구 목적: 이 연구는 신경 공학기술을 활용해 정상 범위의 정신 상태를 원하는 상태로 조절하고자 하는 신경 강화 논의의 법제화를 위하여 신경 강화 규범의 구성 원리를 제안하는 것을 목적으로 한다. 연구 방법: 인간 강화 문제를 바라보는 주요 관점인 생명 보수주의와 트랜스-휴머니즘의 내용과 한계를 검토한다. 연구 내용: 각 관점의 한계를 검토함으로써 신경 강화 규범의 방향성을 제안하고, 그 구체적 방안으로 대화적 규범 구성을 설명한다. 결론 및 제언: 생명 보수주의는 윤리적･형이상학적 이념에 의존함으로써 객관적이고 합리적인 논거를 제시하지 못하고, 트랜스-휴머니즘은 합리적이고 공리주의적인 관점에 매몰되어 윤리적 존재로서 인간의 자기 이해를 훼손하고, 규범의 도덕적 정당성을 확보하지 못한다는 한계를 갖는다. 각 주장의 한계를 극복하는 방법의 핵심은 ‘주체로서의 지위 확보’임을 주장하며, 그 방법으로 규범의 대화적 구성을 제안한다.
Abstract
For the legislation of neuro-enhancement, which intends to control a human’s mind by using neuro-engineering, it proposes a principle for the norm. This paper critically examines two opposite perspectives of neuro-enhancement and the limitations of each perspective. Bioconservatism relies on ethical and metaphysical ideologies, and therefore can not provide objective and rational (legal) basis. On the other hand, trans-humanism undermines the self-understanding of people as ethical beings, and therefore fails to secure the (moral) legitimacy of norm, being trapped in a scientism and utilitarian perspective. Examining each limitations, it argues the key idea of this paper is ‘securing the subjectivity of human being’, and suggests a discursive model as the principle for the norm.
