Abstract

This study aims to examine China’s response to North Korean defectors in China from the perspective of China’s position and international law and to study ways to protect human rights. The research method was based on an analysis of literature based on various data on North Korean defector women in China. The study examines the legal status of North Korean defectors in China under international law, understands China’s response to North Korean defectors in China from China’s point of view, and examines how to protect the human rights of North Korean women in China. Conclusions and suggestions are that under the current international legal order, the determination of a North Korean refugee’s refugee status rests primarily with China, the State Party, so the international legal approach to recognizing refugee status is not realistic. Therefore, an approach that advocates a change in China’s position on not recognizing North Korean defectors as refugees should be avoided. Since the issue of North Korean defectors is a complex issue in which the interests of various countries are intertwined, it is necessary not to limit itself to China’s domestic problems, which have no choice but to focus on its own interests, but to seek solutions in a humanitarian way with neighboring countries.
