탈북여성의 인신매매에 대한관계국의 법제와 과제

이 글은 북･중 접경지역 및 중국 전역에서 이루어지는 탈북여성들의 인신매매 피해 및 관계국들의 법적 대응의 한계를 지적하고, 그 젠더적 함의를 고민하며, 국제사회 및 각 관계국들의 대응과제를 논한다. 보다 구체적으로 이 글은 첫째, 탈북여성들의 탈북과정에서의 인신매매 및 성착취 메커니즘의 전형을 개괄하고, 이것이 국제규범 및 각국의 국내법상 인신매매의 구성요건을 성립함을 주장한다. 둘째, 탈북여성 인신매매의 관계국으로서 북한, 중국, 남한 각 국가가 인신매매에 대하여 가지는 국제규범상 책임 및 국내법상의 법제와 정책의 구비정도를 살펴본다. 이를 통해 각 국가의 인신매매에 대한 법적 정의 및 제도적 격차가 있음을 확인하고, 탈북여성 집단에 특정하여 각 국가의 인신매매 법제의 준수, 이행이 이루어지고 있지 않음을 비판한다. 셋째, 이러한 탈북여성 인신매매 피해 및 그 집단에 특정한 관계국의 ‘묵인’에서 드러나는 젠더적 함의가 한반도 분단의 맥락에서 가지는 의의를 논하며, 분쟁지역 성폭력으로서의 인신매매에 대한 종합적, 입체적 이해와 구체적 제도가 구비되어야 함을 주장한다. 마지막으로 국제규범 및 관계국, 특히 대한민국의 법제가 탈북 인신매매 피해여성의 보호와 지원을 위하여 어떠한 조치를 취할 수 있는지에 대하여 제언한다. 특별히 국제규범 차원의 초국경성 및 지역적 협력을 강화하고, 대한민국이 다수 탈북 인신매매 피해여성의 정착지로서 이들의 피해에 대해 개별적 차원에서 적절한 보호와 지원을 제공하고, 나아가 전환기 정의 차원에서 집단적 피해로서의 탈북 인신매매에 관하여 규명, 조사, 기록, 보관하여야 할 것을 요청한다.

Abstract

This article addresses the problem of human trafficking and sexual exploitation of North Korean women and discusses the gaps between law, policies, and practices in the three relevant countries, namely, North Korea, China, and South Korea, from a gender perspective. Specifically, the article first outlines the classic cases and mechanisms of the human trafficking of female North Korean escapees in China, which can sufficiently constitute “transnational trafficking in persons” defined in international law. Then the article examines the international and national legal responsibilities and points out the gaps among each states’ law and policies on human trafficking. Furthermore, the article criticizes the absence of legal actions, particularly on the trafficking of North Korean women, by shedding light on the different contexts of the three nations’ silences. Third, the article discusses the socio-legal implications of the non-compliance with the human rights duties of two Koreas and China from a gender perspective and calls for a comprehensive approach toward the trafficking of North Korean women as conflict-related sexual violence. Finally, the article offers suggestions for international and national law and policies to sufficiently respond to the human trafficking of North Korean women, with a particular focus on those of South Korea as a hosting country where a significant number of the North Korean trafficking victims resettle.
