국내 조선･해양플랜트 산업과 해운 산업은 유래 없는 장기간의 경기 침체와 물동량 감소로 인하여 많은 어려움을 겪었다. 그럼에도 불구하고, 개별 기업들은 적극적으로 어려움을 해결하기 위한 생존 자구 수단을 마련하기 위하여 구조조정, 영업 이익률 제고 등의 노력을 다하고 있다. 그리고 조선･해양플랜트 산업과 해운산업은 시시각각으로 변화되고 있는 세계 경기 변동 속에서도 안정적으로 발전시키기 위해 해양플랜트 설계, 조달, 건조단계에서 축적한 기술, 경험 및 선박관리업을 통해서 보유하고 있는 국제적인 네트워크 및 관리 시스템을 토대로 해양플랜트 운영관리산업으로 진출하여 새로운 부가가치를 창출하도록 사업구조를 재편하고 있다. 해양플랜트 운영관리산업(offshore plant operation & maintenance industry)은 인력 및 재화에 대한 단순 서비스를 공급하는 일차원적인 업무에서 벗어나 해양플랜트 서비스산업으로 발전 및 도약하기 위한 토대를 제공하고, 지속가능한 부가가치를 창출하는 산업이라고 할 수 있다. 이러한 해양플랜트 운영관리산업은 조선소에서 해양플랜트가 건조된 이후 해체단계에 이르기까지 포괄적인 기술적, 상업적, 법률적 관리를 포함한다. 특히 조선･해양플랜트 산업은 설계, 자재조달, 건조분야에서 쌓은 기술과 경험을 토대로 해양플랜트 운영관리 산업으로 진출하고자 노력하고 있으며, 해운산업 역시 오랫동안 선박 및 선원관리를 통해서 축적한 해외 네트워크 및 시스템을 이용하여 동 산업 분야에 진출하기 위해서 타당성 조사를 진행하고 있다. 그러나 아직까지 개별 기업들의 해외 진출을 제도적으로 뒷받침하고, 문제점을 개선하는데 필요한 관련 학계의 연구가 부족하였다. 따라서 이 연구는 해양플랜트 운영관리계약을 체결하기 위하여 국제적으로 널리 사용되는 계약서 양식 부재함에 따라 우선적으로 해양플랜트 운영관리산업 현황 및 특징, 개념과 정의 그리고 계약 주체별 역할, 업무의 범위, 책임과 의무 등을 SHIPMAN 2009를 기초로 해양플랜트 이해 당사자 간의 복잡한 연결고리에 대하여 검토하였다. 그리고 운영관리계약의 정의, 구조, 당사자간의 책임과 의무에 대하여 분석하여 국내 조선･해양플랜트 관련 기업들이 동 분야에 진출하는데 실무적으로 도움이 되어 향후 다른 호황이 찾아 왔을 때 그 열매를 국내 조선소들이 향유하길 기대한다.
Abstract
Domestic Shipbuilding industries and shipping industry suffered from a long period of economic downturn and reduced the quantity of goods transported in 2016. Nonetheless, individual companies are actively making effort to restructure and improve operating profit margins in order to establish survival methods to resolve the difficulties status. And shipping industries, ship building and offshore plaint industries are restructuring there business structure in order to develop stable despite fluctuations in the global economy changed every moment for the create new value added to expand into the offshore plant operations management industry that based on International network and management system of ship management business and accumulated skills and experience during the offshore engineering, procurement and construction phase. The offshore plant operation & maintenance industry is provides the foundation for development and leap into offshore plant service industry. These offshore plant operation and management industries include comprehensive technical, commercial and legal management from the construction step of the offshore plant to the decommissioning step at the shipyard. However, institutional support for the advancement of the companies and the related academic researches needed to improve the problems have been insufficient. Therefore, this study is to analyzed the current status and characteristics of the offshore plant operation management industry, concept, scope, definition, responsibilities and duties of the contracting parties, in accordance with the absence of widely used international contract form in order to conclude the offshore plant operation management contract Based on SHIPMAN 2009, reviewed the complex links between marine plant stakeholders.
