법치하에서의 다문화사회의 도래 및 이에 대한 국가적 대응은 사회에 대한 법적 해석과 규제를 통해 이루어져야 한다. 현재 대한민국은 다문화사회를 맞이하여 이에 대한 대비책을 강구해야 할 시점에 있고, 이미 이러한 차원에서의 다양한 정책수립 및 시행이 이루어지고 있다. 그런데 이러한 다문화사회에 대한 국가적 대응으로서의 현상들은 우리사회가 직면한 현실에 관한 사회적 합의 및 명확한 입장규명이 이루어지지 못한 상태에서의 산재한 대응에 불과함을 살펴볼 수 있다. 이른바 사회통합을 이루고자 하는 다문화사회의 궁극적 기조 하에서 우리는 그야말로 진정한 사회통합을 실현하기 위하여 어떠한 기본원칙을 수립하고 이를 정책에 반영하여야 할 것인지에 대한 심도있는 논의를 하여야 한다. 한편, 다문화사회에 대응하기 위한 현실적 과제로서의 다문화 규제를 강구함에 있어서는 재한 외국인에 대한 통합적 정책방안을 전제로 각 유입유형별 재한 외국인에 대한 개별 법률을 마련해야 할 필요가 있다. 이를 위해서는 현재 부재하는 다문화사회 관련 국가대응기본법의 마련과 동시에 현재 규제되고 있는 관련 실정법을 포함한 개별 법률을 형식적․내용적 측면에서 내실화할 필요가 있다. 이러한 다문화사회에 관한 법적 해석 및 규제 확보를 통하여 진정성 있고 명확한 다문화사회에 대한 국가의 대응을 현실화할 수 있을 것이다.
Abstract
The advent of a multi-cultural society under the rule of law and the national response should be done through legal interpretation and regulation for our society. Currently the Republic of Korea is at the time of preparedness to make a preparation for multi-cultural society and we already have a variety of policy formulation and implementation. By the way phenomena such as the national response on a multi-cultural society don’t indicate social consensus about the reality and the clear stance. Ultimately under the keynote, the so-called multi-cultural society, we truly have to establish some basic principles and discuss this policy to realize the true social integration. Meanwhile, we need to do the real challenge for a multi-cultural society as a cultural response to the regulation and we have to make each individual laws by type of foreigners in Korea. To do this, we have to make National Response Framework Act for a multi-cultural society and concurrently the individual laws including the current regulations need to ensure internal stability in all its aspects. It will be able to be realized clear and real respond through legal analysis and regulation on multi-cultural society.
