가족관계 관련 증인제도의 개선방안에 관한 연구

우리나라에서는 경제발전과 더불어 신용사회 실현 및 개인정보 보호 등을 고려하여 절차적 번거로움과 실효성이 낮은 보증인제도가 폐지되고 있는 실정이다. 그러나 가족관계와 관련하여서는 출생신고, 혼인신고, 사망신고 등의 증인제도의 개선이 필요한 상황이고, 그 밖에 신원진술서 등의 보증인제도, 임원약정서의 연대보증제도, 인감신고시의 인우보증제도의 개선이 필요한 상황이다. 이러한 제도 개선을 위하여 다양한 방안이 생각될 수 있으나, 가족관계와 관련하여서는 우선 출생신고의 경우에 의료기관이나 관공서를 통한 출생증명의 확인제도를 이용하는 것이 필요하다. 또한 혼인신고와 관련하여서는 다양한 제도 구상을 할 수 있으나, 온라인을 이용한 혼인의사사실등록확인제도를 활용하는 것이 효율적일 것이다. 그리고 사망신고에는 행정검시 만을 이용하여 신고 내용의 진정성을 확보할 필요가 있다. 그 밖의 주요한 증인제도로서 우선 신원진술서 등의 보증인제도는 관련 기관의 신원진술서 등의 서식의 개선이 필요하고, 입원약정서의 연대보증제도는 연대보증인 관련 규정을 삭제하는 대신에, 저소득층에 대해서는 바우처제도를 활용할 수 있을 것이다. 그리고 인감신고시의 인우보증제도와 관련하여서는 전자본인서명사실확인 시스템을 활용하는 것이 필요할 것이다. 물론 이러한 제도 개선에 있어서는 법제적인 근거규정 및 법률의 일부 개정이 필요할 것이다. 다만, 이러한 법제적인 개선에 있어서도 전면적인 법제 개선보다는 단계적인 법제 개선을 하는 것이 국민적 법 감정에도 적정하고, 법제의 사회적 타당성과 법적 안정성의 조화에도 기여할 수 있기 때문이다.
Abstract
It is actual situation that a surety system of which procedure is complex and efficacy is low is abrogated in consideration of the realization of credit society and the protection of personal information, etc. in Korea. However, it is required to improve the witness system of the birth registration, marriage registration and death registration, etc. in relation to the family relationship. Further, it is required to improve the surety system of an identity statement, etc. and the joint surety system of a director agreement and the friendship surety of a seal registration. Even though various plan can be devised for the improvement of these systems, in case of a birth registration first of all in relation to family relationship, it is necessary to use the confirmation system of the birth certification via medical institutions or public agencies. Also, even though various systems relating to a marriage registration can be devised, it may be effective to utilize the confirmation system for the registration of an intent to marry using on-line system. Moreover, it is necessary to secure the truth of registration matters in the death registration using only an administrative death investigation. In other principal witness systems, first of all, the surety system of an identity statement, etc. requires to improve the format of an identity statement, etc. in relevant agencies and the joint surety system of a director agreement may utilize a voucher system to a low income bracket instead of deleting the relevant provisions of a joint surety. Moreover, it is necessary to utilize the electronic personal signature confirmation system in relation to the friendship surety of a seal registration. As a matter of course, it is required to amend partially the legislative applicable provisions and regulations for the improvement of these systems. However, with regard to these legislative improvements, the phased legislative improvement rather than entire legislative improvement will be appropriate to people's legal emotion and can contribute to the social validation of legislation and the harmony of legislative stability.
