동물복지정책의 비용편익 식별 및 추정방안 - 법적 정합성 및 감정적 효용을 중심으로 -

본 논문은 동물복지정책의 규제영향분석 시 비용과 편익을 식별하고 추정하는 방안에 대하여 고찰하고 있다. 우리나라 헌법 제2장 국민의 권리와 의무에서는 제10조부터 제39조에 이르기까지 자유와 책임, 의무와 권리를 사람에게만 부여하고 있으며, 행정규제기본법 제2조에서는 행정규제를 정의하면서 규제의 대상을 (국내법을 적용받는 외국인을 포함한)국민에 한정하고 있다. 따라서 행정규제기본법 제7조에 의해 수행되는 규제영향분석이 법적 정합성을 유지하기 위해서는 규제로 인해 비용이나 편익이 발생하는 대상이 동물이 아닌 오직 인간뿐이어야 하며, 이는 동물의 편의 및 복지와 관련된 규제정책의 경우에도 마찬가지다. 반면, 규제영향분석은 규제정책 도입 시 발생할 사회전반의 득실을 따져 합리적인 규제인지 판단하는 것을 목표로 하므로, 동물복지정책을 판단할 때 동물복지수준 제고에 대한 사회적 요구가 다른 사회적 파급효과와 마찬가지로 정책도입의 고려요소로 반영되는 것이 옳다. 단, 동물복지의 편익을 반영하되 그 수혜자를 사람으로 한정하기 위해서, 본 연구는 동물복지에 주로 공감의 형태로 반응하는 인간의 감정적 효용이라는 가치를 설정하고 그 과정을 고찰한다. 감정적 효용의 크기는 동물에 대한 친밀도, 동정심, 정의감과 연관이 있을 것으로 사료되며, 정량화된 편익으로 규제영향분석에 반영되기 위해서는 감정적 효용의 화폐가치화뿐만 아니라 각 정책이 얼마만큼의 동물복지 효과를 발생시킬 것인가도 계량이 가능해야 한다. 이를 위해서는 해외의 정책효과 사례를 수집하여 분석하는 것이 필요하며, 국내정책 중 파급효과가 큰 것에 우선을 둔 효과측정 연구가 선행되어야 한다. 축산업이 가장 최적의 생산규모와 가격을 유지하고 있을 때 동물복지규제가 도입되어 생산비용을 증가시키면 단기적으로는 규제로 인해 축산업계에 발생할 비용이 편익보다 클 수밖에 없다. 이러한 경우 해당 규제는 정당성을 확보하기 어려워 보일 수 있는데, 이해관계자로서 업계뿐만 아닌 국민의 편익까지 감정적 효용가치 추정을 통해 고려할 수 있다면, 당국은 보다 포괄적ㆍ합리적으로 규제정책의 도입여부를 고민할 수 있게 될 것이다.
Abstract
This article discusses discerning and estimating approach of cost-benefit for animal welfare policies. Our Constitution grants freedom, responsibilities, duties and right only to humans, and Framework Act on Administrative Regulations is applied only to citizens. Therefore, in order to maintain legal consistency, who taking costs or benefits in Regulatory Impact Assessment(RIA) conducted in accordance with the Framework act on Administrative Regulation should be only humans, not animals, even for regulatory policies related to animal welfare. On the other hand, since RIA aims to determine whether it is a reasonable regulation, based on the overall social gains and losses that will occur by introduction of regulatory policies, social needs for raising animal welfare levels should be considered as one of determinants when it comes to animal welfare policy. However, in order to consider benefits of animal welfare but limit its beneficiaries to humans, we set the value of emotional utility (mainly in the form of empathy) of human and consider its process. The size of emotional utility might be related to affinity, compassion and justice for animals. To measure quantified benefits, we need not only monetary value of the emotional utility but also how much the policy effects on animal welfare. For this reason, the cases of foreign countries and effects of domestic policies should be researched even further. If animal welfare regulations increase production costs while the livestock industry maintains the most optimal size and price, in the short run, the costs are bound to outweigh the benefits. In this case, the emotional utility value need to be discussed to make comprehensive and rational decision- making.
