Abstract

Korean War Crimes Division was established a part of office of the judge advocate general in Eight Army in October 1950, acted to April 1954 during Korean War. The purpose of KWC was that frist, prosecution for war crimes and collecting and being preserved evidences of war crimes incidents caused by North Korean People's Army and Chinese Peoples Volunteers. This is associated with the 1949 Geneva Convention on prisoners of war by the treatment given to the rights of prisoners of war was reflected. According to the final and historical report of KWC, a total of 1,800 incident cases of war crimes happened during Korean war, and 78 incidents of them were ‘political crimes’ that cased by Home department and State Political security Department in North Korea areas from September to December 1950, after an order to retreat because of UN occupation to north of the 38th parallel. This paper analyzes that the aspects of the content and the occurrence of genocide named ‘political crimes’ in the KWC reports. According to KWC Reports, anti-communist uprising by the planning, implementation, and this process, those involved in the riots and ‘reactionaries’ and civilians were sacrificed from September to October 1950. And the army and the local guerrillas to retreat by the ‘reactionaries’ executions were sporadically. In addition, political criminals in correctional centers and labor camps are ‘appropriate treatment’ organized by the command of the military committee and were executed by the decisions of the camp guards. These show that the cross-sectional nature of the massacre of the victim and the type of political criminals in the name of ‘reactionary’ civilians a period of KAPA retreat.
