과학의 발전으로 인한 통신기기의 혁신은 생활의 편리함도 제공하지만, 사회의 병리적 현상의 단초가 되기도 한다. 대표적인 것이 휴대폰을 이용한 음란물의 유통(sexting)이다. 인터넷을 통한 음란물 보다 더욱 청소년들에게 악영향을 미칠 수 있는 휴대폰을 통한 음란물 유통에 대한 사회적 우려에도 불구하고, 이에 대한 실증적인 연구는 부족한 실정이며, 특히 연구 결과를 바탕으로 한 입법 및 형사사법 정책의 수립은 전무한 실정이다. 이에 본 연구는, 국내 실증연구 결과를 종합적으로 정리하고, 이를 바탕으로 청소년의 섹스팅에 대한 입법 및 형사사법 정책의 방향을 제시하고자 하였다. 2009년에 실시된 국내 청소년 섹스팅 설문조사와 그 데이터를 심층적으로 분석한 두 연구, 몇몇 논문들을 바탕으로, 본 논문은 규제 관련 정책과 예방 관련 정책을 제시하였고, 해외 섹스팅 관련 입법 동향을 간략히 소개하였다. 본 논문을 단초로 국내 청소년 섹스팅 관련 논의가 본격적으로 진행되기를 희망한다.
Abstract
IT(information technology) has been evolved drastically based on development of scientifical technologies, and it has brought convenient life styles in various ways for modern society. However, it also brought criminological and pathological problems to the modern society. One of the problems is trafficking sexually explicit materials including pornography through portable communication devices, such as smart phone. Particularly, youths are vulnerable population for such harmful contents in cyber space. Nonetheless study of youth sexting has not received attention from Korean academia as well as policy makers. To spark social discussion on sexting and to provide new policy implications for criminal justice system in South Korea, this study introduced two empirical studies on sexting conducted in South Korea, and provided policy implications for criminal justice system in Korea. It was this study’s intention to ignite academic discussion and policy development for youth sexting in South Korea.
