섹스팅과 리벤지 포르노의 범죄화 및 처벌법 쟁점 연구

초록

이 연구는 섹스팅과 리벤지 포르노, 즉 디지털 성범죄가 심각해짐에 따라 향후 바람직한 관련법의 정비방향을 제시하는데 그 목적을 두었다. 섹스팅 및 리벤지 포르노에 대한 국내 연구는 매우 제한적이지만, 이미 국외에서는 관련 연구가 매우 활발하게 진행되고 있다. 특히 영국과 미국의 30여개의 주정부, 일본, 이스라엘 등에서는 별도의 섹스팅법 및 리벤지 포르노법을 제정하여 시행 중인 것으로 나타났다. 이에 비해 현행 성폭력처벌법 및 아동청소년의 성보호에 관한 법률은 섹스팅 및 리벤지 포르노를 처벌하는 데에는 그 한계가 있다. 대법원 역시 매우 제한적인 처벌입장을 보이고 있다. 나아가 정부의 개정 법률안 역시 문제점을 안고 있다. 따라서 이 연구는 섹스팅과 리벤지 포르노 처벌과 관련한 법적 정비 방향을 다음과 같이 제시한다. 첫째, 섹스팅 및 리벤지 포르노 처벌법의 정비시 개인의 표현의 자유 및 성적 자기의사결정권의 적절한 조화점을 찾아야 한다. 둘째, 섹스팅 및 리벤지 포르노를 처벌하는 경우에도 이의 전달매체인 전기통신사업자 또는 통신망사업자 등의 자기검열기능권과 개인정보보호권 간 충돌의 최저지점을 찾아야 한다. 셋째, 섹스팅 처벌범위를 확대할 경우 섹스팅 범죄경력자의 양산문제와 그로 인한 사회적 교정비용 등이 고려되어야 한다. 넷째, 섹스팅에 대한 개념정의를 확대하여야 한다. 다섯째, 리벤지 포르노에 대한 명확한 개념정의가 필요하다. 여섯째, 섹스팅과 리벤지 포르노를 성폭력특별법에 통합규정으로 만들어 처벌의 균형성을 확보하여야 한다. 일곱째, 청소년의 섹스팅을 처벌하되, 초범자에 대한 다이버전제를 도입하여야 한다. 여덟 번째, 섹스팅과 리벤지 포르노에 대한 처벌규정은 행위의 반복성, 동의된 성적 이미지여부, 수신된 정보의 재작성여부 등 그 양태에 따라 보다 정교하게 구분되어야 한다.

Abstract

The purpose of this study is to suggest the direction of the future related laws according to the seriousness of digital sex crime as sexting and revenge porno(pornography). Research on sexting and revenge porno is very limited, but international studies are already very active. In particular, more than 30 provinces in the United States and the United Kingdom, Japan and Israel have already enacted separate sexting and revenge pornography laws. On the other hand, the current law on sexual violence punishment and the protection of sex of children and Special Act on Sexual Abuse have limitations in penalizing sexting and revenge pornography. The Supreme Court is also in a very restrictive position. Furthermore, The government's revised law, released on September 26, 2017, also has many problems. Therefore, this study suggests legal maintenance directions related to sexting and revenge pornography as follows. First, when maintaining punishment for sexting and revenge pornography, it is necessary to find an appropriate harmony of freedom of expression of the individual and the right of sexual self-determination. Second, even in the case of penalizing sexting and revenge pornography, it is necessary to find the lowest point of conflict between the rights of the self-censorship function of the telecommunication service provider or the telecommunication network operator and the personal information protection right. Third, if the scope of punishment for sexting is expanded, the problem of mass production of sexing criminals and their social correction costs should be taken into account. Fourth, the concept definition for sexting should be expanded. Fifth, definitive concept definition of revenge porn is needed. Sixth, sexting and revenge pornography should be integrated in the Special Act on Sexual assault to ensure the equilibrium of punishment. Seventh, the punishment of sexting of young people should be introduced, but A diversion system for the first juvenile offenders is necessary. Eighth, penalties for sexting and revenge pornography should be more precisely classified according to the mode of repetition of the act, whether it is an agreed sexual image, whether or not the received information is rewritten, and so on.
