여성수용자 양육유아처우에 대한 비교고찰 : 호주를 중심으로

본 연구는 여성수용자 양육유아처우 제도의 방향성을 탐색하고 교정처우 방안을 제시하기 위한 비교고찰 연구로, 교정시설 내 양육유아와 관련된 처우의 역사가 깊고 사법 및 복지시스템의 필요성에 맞는 다양한 처우를 제공하고 있는 호주의 양육유아처우 제도를 살펴보았다. 연구결과 양육유아 연령은 한국의 경우 교정시설 내 최대 거주기간이 생후 18개월까지이지만, 호주는 최대 6세까지 거주가 가능한 것으로 나타났다. 시설과 프로그램의 경우 한국은 일반 수용자의 수용실과 같은 공간에서 모(母)인 여성수용자와 양육유아가 함께 생활하는 반면, 호주 대부분의 교정시설에서는 여성수용자와 양육유아, 산모와 아기가 일반 교정시설이 아닌 별도 거주공간에서 자율적으로 생활하고 있었다. 모(母)인 여성수용자를 위한 프로그램의 경우 한국은 ‘어머니 교육’, ‘돌잔치’, ‘가족접견’ 등이 주를 이루는 반면, 호주는 ‘유대감 강화’, ‘멘토링’, ‘심리ㆍ교육’, ‘치료’ 등 여성수용자와 양육유아를 위한 다양한 프로그램이 제공되고 있는 것으로 나타났다. 여성수용자와 양육유아 분리의 경우 한국은 유아를 가족(보호자)에게 인계하거나 대부분은 입양, 아동양육시설 등의 외부단체에 보내지는 것에 비해, 호주는 적절한 양육자가 없을 경우 복지기관ㆍ학교ㆍ병원ㆍ경찰ㆍ청소년지원센터ㆍ정신건강센터 등의 각종 지원을 받아 아동의 양육에 가장 적절한 곳에 보내진다. 이러한 연구결과를 바탕으로 여성수용자와 양육유아처우에 관한 정책적인 시사점을 제시하였다.
Abstract
The purpose of the study is to provide the future direction of the services for female inmates with children by comparing the South Korean system with the Australian system. According to the review of the literature, the maximum residence period in a correctional facility is up to 18 months in South Korea, whereas it is up to 6 years of age in Australia. In terms of facilities and programs, in Korea, female inmates and their infants live together in the same place as other inmates’s. Mothers and children live in a specially designed place, equipped with necessary utilities in order to meet their needs in Australia. Compared to Korea, mainly providing 'mother education', 'birthday party', and 'family visit' for female inmates with children, Australia provides mothers and children with various programs, such as 'strengthening bond', 'mentoring', 'psychological education', and 'special treatment'. When children are to be separated from their mothers, children are sent to their families(guardians) or to organizations such as adoption or foster care facilities in Korea. In Australia, if there is no suitable caregiver, the child is sent to a place, after considerate reviewing the feasible services from various organizations, such as welfare institutions, schools, hospitals, police, youth support centers, and mental health centers. Based on the results, policy implications are provided for female inmates with children in correctional facilities.
