Abstract
In many sexual assault cases, bedding and clothing are essential pieces of evidence that are screened for semen stains to gather DNA from the assailant. For the presence of semen, which is generally accepted as an important biological evidence in sexual assault cases, presumptive and confirmatory tests are performed before DNA analysis in a way that saves time and expense. However, positive results from both tests do not necessarily mean that the accused’s DNA profile is detected. If the amount of DNA is generally insufficient or exists in a severely decomposed state, the DNA profile may not be detected. On the other hand, although the semen test (Acid phosphatase test) on the panties was negative, DNA profiles of female victims and the male accused were sometimes clearly detected in experiments by using the differential lysis method. This is because fabrics such as panties can retain sperm even after being washed under various conditions. Recently the same situation is sometimes observed in panties, which are evidence of a sexual assault case analyzed in the Gwangju NFS. Since sperms can be observed even in fabrics that have been washed several times, the semenogelin detection test should be additionally performed as a confirmatory test. This study reports these cases and discuss on the need for confirmatory testing.
