본 연구의 목적은 경찰단계에서 공용할 수 있는 범죄피해자 신변보호 위험성 평가도구의 개선방안을 제시하는 데 있다. 특히 범죄피해자 신변보호의 판단 기준이 모호하다는 실정에 부응하기 위하여 피해자 신변의 위험성을 객관적으로 측정하고 평가할 수 있는 위험성 평가도구의 개선방안을 고안하였다. 본 연구에서 고안하고 있는 위험성 평가도구의 기본방향은 1) 현재 발생하는 위험의 수준보다는 예견 가능한 위험의 수준을 기준으로 평가도구를 보완, 2) 가해자와 피해자의 관계를 파악, 3) 가해자의 정보를 정확하게 파악할 수 있는 경우와 가해자의 정보가 불확실한 경우로 구분하여 평가 기준을 제시, 4) 가해자의 특성에서 과거 범죄경력, 알코올 및 음주 관련 문제, 가해자의 직업 등 신변위협과 관련이 높은 위험요인들을 파악 등과 같은 측면이다. 개선된 범죄피해자 신변보호 위험성 평가도구는 언급한 기본방향에 따라 평가 기준을 보다 객관화하였으며, 평가방법도 손쉽게 활용할 수 있는 단계별 위험성 판단 체크리스트를 제시하였다. 또한, 위험 매트릭스 방식을 응용하여 발생가능성과 결과/영향이라는 두 가지 속성을 토대로 위험 수준을 7등급으로 제시하였다. 그리고 가해자 정보를 알지 못하는 경우에도 피해자 면담 자료로 작성된 1단계 체크리스트만으로 위험 수준을 평가할 방법을 제안하였다.
Abstract
The purpose of this study is to suggest ways of improving protection for crime victims risk assessment tool that can be shared by the police. Especially it devised a development plan for risk assessment tool that can be objectively measured and evaluated as a victim of personal risk in order to meet the situation that is ambiguous criterion of protection for crime victims. Basic direction of the Risk Assessment Tools: 1) complement the assessment tool based on the level of foreseeable risks rather than the level of risk that the current generation, 2) determine the relationship between the perpetrator and the victim, 3) If you can pinpoint the perpetrators of information and the perpetrators of the information presented evaluation criteria, separated by a case of doubt, and 4) the aspects, such as understanding the past criminal history, alcohol and alcohol-related problems, the perpetrators of the job, such as personal threats and related high-risk factors in the offender's property. Enhanced risk assessment tools were improved objective and make it easier to use. In addition, the risk assessment tool was presented a level of risk based on the likelihood and consequences of the two properties generated by applying the risk matrix method to grade seven. And this tools was to assess the level of risk, even if the victim does not know information of offender.
