현재 경찰은 「경찰관 직무집행법」 제2조 2호 2에 명시된 바와 같이, 범죄피해자 보호를 위한 직무를 수행하고 있다. 경찰은 일선 현장에서 범죄자에 대한 조치와 함께 피해자에 대한 보호조치 및 보호 지원의 중요한 패러다임이 된 현시점에서 범죄 위협에 대한 위험성 평가의 중요성이 강조되고 있다. 그러나 그동안 실무현장에서는 피해자의 안전조치를 평가하는 담당자의 전문성 부족과 안전조치를 내리기까지의 실효성 있는 정보가 부족한 상황임에도 안전조치를 위해 체크리스트가 사용되어 실무현장에서 정확한 판단이 어려운 측면이 존재하기 때문에 그 적절성에 대해 의문이 반복적으로 제기되고 있다. 따라서 위험성 평가도구가 현장 실무자에게 편리하고 정확한 도구로 활용되기 위해서는 위험성 평가의 기본 원칙을 확인하고, 현행 도구의 적합성 여부를 판단하는 연구가 반드시 병행되어야 한다. 다행스럽게도 2023년부터 적용되고 있는 현행 안전조치 위험성 판단 도구는 기존 도구가 가지고 있던 한계를 대폭 개선하여 도구 자체의 적합성은 높은 것으로 판단된다. 그러나 실제 적용 과정에서 발생할 수 있는 한계를 확인하고 다음과 같이 개선방안을 도출하였다. 특히 안전조치 판단이 이뤄지는 현장의 특성과 평가자인 경찰관의 특성을 고려한 안전조치 판단의 체계의 운영이 중요함을 강조하였다. 현행 판단 도구의 한계를 극복하기 위해서는 필연적으로 실무 평가자인 경찰관의 경험 축적과 전문성 제고가 필요하다. 현장에서 발생하는 범죄 유형의 다양성, 가해자의 위협 수준, 피해자의 피해 정도를 파악하여 피해자에게 적합한 판단을 내릴 수 있는 전문성 향상을 위한 절차를 마련할 필요가 있다. 실무 평가자는 기본 및 보수교육 등을 통해 평가 방법을 학습하여 표준화된 방식을 적용했을 때 평가의 오류를 줄여나갈 수 있을 것이다. 적절한 도구의 개발뿐만 아니라 현장에서의 노력과 경험이 합쳐졌을 때 범죄로 고통받는 피해자에게 적절한 안전조치를 제공할 수 있다.
Abstract
Currently, the police are performing their duties to protect crime victims, as specified in Article 2, No. 2, 2 of the Police Officer Duties Execution Act. The importance of risk assessment of criminal threats is being emphasized at a time when police have become an important paradigm for protecting and supporting victims along with taking action against criminals on the front line. However, in practice, checklists have been used even in situations where there is a lack of expertise of the person in charge of evaluating the victim's safety measures and a lack of effective information to take safety measures, so limitations in the accuracy of safety measure judgment have been pointed out. Fortunately, the current safety intervention risk assessment tool, which has been applied since 2023, is judged to have many advantages in terms of the suitability of the tool itself, as it has significantly improved the limitations of the existing tool. However, we identified the limitations that may occur in the actual application process and derived improvement plans as follows. In particular, he emphasized the importance of operating a system for judging safety intervention that takes into account the characteristics of the site where the safety intervention are judged and the characteristics of the police officers who are the evaluators. In order to overcome the limitations of the current judgment tools, it is necessary to accumulate experience and enhance the professionalism of police officers, who are practical evaluators. There is a need to establish procedures for improving professionalism to identify the diversity of crime types that occur in the field, the level of threat from the perpetrators, and the degree of damage to the victims, so that they can make appropriate judgments for the victims. Practical evaluators will be able to learn evaluation methods through basic and conservative training, and reduce evaluation errors when standardized methods are applied. The combination of on-the-ground efforts and experience, as well as the development of appropriate tools, can provide adequate safeguards for victims of crime.
