테러 사례 분석을 통한 경찰의 효율적 테러대응에 관한 연구 - 통합 시스템 관점을 중심으로 -

본 연구는 미국 뉴욕 9․11 테러, 스페인 마드리드 3․11 열차 폭탄테러, 영국 런던 7․7 연쇄 폭탄테러 사례를 비교․분석한 후 그에 따른 시사점을 도출하여 통합 시스템 관점에서 향후 우리나라 경찰의 효율적인 테러대응을 모색하는데 그 목적이 있다. 본 연구를 통해 알 수 있었던 각국에서 발생한 테러 사례의 특징 및 시사점을 통합 시스템 관점에서 정리하면 기존의 테러 관련 법률로부터 테러 위협에 대처하고, 정보 공유의 부재로 인한 테러방지 실패 원인을 유발할 수 있었던 분산 시스템을 테러방지라는 거시적 차원에서 테러 관련 법률들을 통합하며 수사기관의 기능을 강화하고, 통합형 정보체제 구축의 일환인 컨트롤 타워를 신설하는 통합 시스템으로 전환하였다는 점은 우리에게 시사하는 바가 크다. 이러한 시사점을 통한 향후 경찰의 효율적 테러대응을 제시하면 첫째, 테러관리 각 과정의 모든 단계별 경찰의 역할이 효과성을 갖도록 하기 위해서는 「국민보호와 공공안전을 위한 테러방지법」에서 규정하고 있는 다중이용시설과 국가 중요행사에 대한 안전관리 대책에 관한 사항이 명시되어야 할 것이다. 둘째, 「국민보호와 공공안전을 위한 테러방지법」의 제정에 있어 세부법안 입법과정으로 인하여 아직 시행되지 않은 조항들 중 영국의 JTAC와 같은 파견업무형태는 경찰의 특화된 정보능력을 충분히 살릴 수 있다. 셋째, 정보전달의 일원화를 통한 종합적 관리를 위하여 대테러센터 내 별도 경찰조직팀을 구성하는 조항이 마련되어져야 할 것이다. 또한 통합 시스템적 사고를 기반으로 구체적인 내용들로 규정하여 실효성 있는 법제로 시행되어져야 할 것이다.
Abstract
This study, through the cases of 9․11 Terror occurred in New York, 3․11 Train Bombings Terror in Madrid, Spain, and 7․7 Serial Bombings Terror in England, aims at analyzing comparatively the terrors in the systematic point of view, at drawing suggestions, and at looking into the direction to response terrors directively. This study arranged, in the point of integrated system, the peculiarities and suggestions of terror accidents occurred in respective nations detected from this study. Considering on the approach to systematic thoughts, it suggests to us greatly that our country coped with terror threatening, by checking the law related to existing terror, integrated laws related to terrors in the macrolevel, because disperse system may bring about failure cause in terror prevention due to absence of information share, and changed them into an integrated system, by strengthening investigation organization function and establishing control tower to construct integration-type information system. This study presented some development directions for police to cope with terror effectively in the future through this suggestion. First, for the police roles to be effective, classified with all of the steps in terror management processes, our country has to specify the matters about safety management measure on multi-use facilities and safety management at the time of national major events regulated by 「anti-terrorism law for people protection and public safety」. Second, in the course of establishing 「anti-terrorism law for people protection and public safety」, the types of secondment such as JTAC of the UK which don't come into force due to the legislation process of detailed bill can emphasize the specialized ability in information sufficiently that police holds. Third, for the purpose of comprehensive management through the unification of information conveyance, a provision has to be established so that a separate police team can be organized in the counterterrorism center. In addition, our country has to enforce the law effectively by defining concrete contents, basing on comprehensive systemic thoughts.
