오늘날 국내외 테러환경 패러다임의 변화는 테러공격의 예측가능성을 상대적으로 어렵게 만들었으며, 결과적으로 대테러정책은 인권침해와의 관계에서 자유롭지 못한 상황이 전개되고 있는 실정이다. 이와 같이 인권에 대한 가치보호와 국가안보 수호라는 법익 충돌은 대테러정책과 무관하게 또 다른 사회구성원의 갈등을 야기 시키고 있다. 최근 국제연합을 중심으로 국제사회에서는 테러리즘과 관련하여 안전보장과 인권과의 조화문제가 강조되고 있으며, 대테러정책에서도 국가의 안전보장과 인권보호 문제에 적극적으로 논의하고 있다. 이는 법집행기관의 대테러정책 시행에 있어 인권침해 소지가 있는 사항에 대한 법적ㆍ제도적 안전장치 마련의 필요성이 강조되기도 한다. 결국 국가안보 수호는 국민의 기본권을 필요적으로 제한할 수밖에 없기 때문에 법적 안전장치를 마련하고, 두 법익에 대한 충돌을 최소화하여 합목적적인 대테러정책을 시행해야 한다.
Abstract
Today, the change in the paradigm of domestic and international terrorism environment has made the terrorist attack more difficult to predict, and as a result, counterterrorism policies are not free from the relationship with human rights violations. As such, the conflict of interests of human rights and national security is causing conflict among other members of society regardless of counterterrorism policy. In recent years, the United Nations and the international community have emphasized the issue of harmonization between national security and human rights in relation to terrorism. These changes emphasizes the necessity of establishing legal and institutional safeguards against matters that have human rights violations in the implementation of counterterrorism policies by law enforcement agencies. Finally, the protection of national security must limit the basic rights of the people. Therefore, it is necessary to implement a comprehensive counterterrorism policy by minimizing the conflicts on the two legal interests.
