항만자치시대의 지방자치단체는 해양항만환경 변화에 능동적으로 대처해 나가기 위해 시정과 항정이 원활하게 조화할 수 있는 자치입법 체계를 구축해야 한다. 이에 본문에서 부산시와 타시도의 해양항만 관련 조례 제정 현황을 비교 분석하고 문제점을 도출한 후 부산항 발전을 위한 조례 제개정안을 제시하였다. 제시된 조례안은 능동적 성격의 자치조례라는데 의의가 있다. 이는 지방분권시대의 지방자치단체는 항만 관련 사업과 연관된 조례를 개발해 나가면서, 항만자치권을 스스로 확보해 나가는 역량을 보여주어야 하기 때문이다.
Abstract
In the era of port autonomy, the local government have to make up the foundation for establishing the self-governing legislation system to adjust the city and the port development plan, in response to the changing maritime and port environment,This study suggests the enactment and amendment of by-laws for the development of Busan Port by comparing and analysing the port related by-laws between Busan Metropolitan City and other local governments. As a autonomous legislation, the suggested ordinances are significant. By introducing and enacting by-laws related to port businesses, the local government itself in the era of deconcentration is required to show the competence and enhance the function to port autonomous rights.
