정신질환 범죄자에 대한 경찰대응의 문제점과 개선방안

2022년 1월부터 12월까지 열린 존속살해ㆍ미수 1심 판결을 분석한 결과, 피고인이 조현병 등 정신과 이력이 있는 경우가 64.7%를 차지했다. 2023년 8월 3일 18:00경 경기도 성남시 분당구 서현역 부근 AK백화점 횡단보도와 백화점에서 일어난 최원종에 의한 흉기난동으로 2명의 사망자와 12명의 부상자가 발생했다. 최원종은 과거 정신과 치료전력이 있고 환상에 시달리며 범행을 저질렀다. 정신질환에 의한 자ㆍ타해 위험은 항상 존재한다. 경찰은 정신질환으로 인한 범죄현장에 출동하면 흉기 든 정신질환자에 대한 경찰 물리력 사용과 응급입원 등의 대응을 하게 된다. 이러한 정신질환자에 대한 경찰대응을 개선하여 국민의 일상이 평온하게 유지되는 것이 이 연구의 목적이다. 이 연구에서는 정신질환 범죄자에 대한 경찰대응의 개선방안으로 정신질환자에 대한 물리력 사용 개선, 정신질환자 병원입원에 대한 대응인력 증원, 정신질환자에 대한 전문성 확보 및 정신질환자에 의한 범죄의 계량화를 제시하였다. 이 연구는 주로 문헌연구방법으로 분석하였고, 파출소에서 팀장으로 근무한 경험과 동료 경찰관들의 면담자료를 보조적으로 활용하였다.
Abstract
As a result of analyzing the first trial judgments of parricide and attempted parricide held from January to December 2022, 64.7% of the cases were that the defendant had a psychiatric history such as schizophrenia. On August 3, 2023, around 18:00, two people died and 12 were injured in a knife attack by Choi Wonjong that occurred on the crosswalk and inside the AK Department Store near Seohyeon Station, in Bundang-gu, Gyeonggi Province and inside the department store. Choi Wonjong had a history of psychiatric treatment in the past and committed the crime while suffering from hallucinations. There is always a risk of harm to oneself or others due to mental illness. When the police are dispatched to the scene of a crime due to mental illness, they respond by using physical force and emergency hospitalization of the mentally illness person holding a weapon. This study was mainly analyzed using the literature research method, and additionally used the experience of working as a team leader at a police box and interview data from fellow police officers. Improvement measures included improving the use of physical force against person of mental illness, increasing personnel to respond to hospitalization of mentally illness person in hospitals, securing expertise on mentally illess person, and quantification of crimes against person of mental illness.
