우리나라의 불심검문 제도가 임의적 규정으로 강제처분이 불가능하여 범죄의 발견과 범인 검거라는 경찰 목적 달성에 대한 불심검문의 실효성에 의문이 제기되고 있는 상황에서 이 연구는 미국과 영국의 불심검문 제도를 바탕으로 우리나라의 불심검문 제도 개선에 대한 시사점을 찾아보고자 하였다. 미국의 불심검문(Stop and Frisk)은 법집행기관이 구체적인 사실과 상황에 근거하여 범죄가 범하여졌거나 범하여지려고 하고 있고 검문 대상자가무기를 가지고 있으며 위험하다는 합리적 의심(Reasonable suspicion)을가지고 있을 때 검문 대상자를 정지시켜 수색을 할 수 있는 제도를 말한다. 영국의 불심검문(Stop and Search)은 마약이나 무기 또는 훔친 물건 등의불법적인 물품을 소지하고 있다고 의심되는 사람을 수색할 수 있는 경찰의권한이다. 이 연구는 미국과 영국의 제도를 반영한 우리나라 불심검문 제도 개선에대한 시사점을 제시하였다. 첫째, 불심검문 권한 남용의 방지를 위해 정지대상자의 기준에 무기나 범죄와 관련된 물품을 소지하고 있다고 의심할만한 상당한 이유를 추가할 필요가 있다. 둘째, 불심검문 시 무기나 범죄와관련된 물품에 대한 신체 수색을 법률로 규정할 것을 제안하였다. 셋째, 범죄를 범하였거나 범하려고 하고 있다고 의심할 만한 상당한 이유가 없더라고 범죄의 위험이 클 것으로 예상되는 지역에서의 제한 없는 불심검문을제안하였다.
Abstract
Questions are being raised about the effectiveness of the Korea police stop and question to find crimes and arrest criminals, because it is impossible to be forced due to optional rules, so the study tries to find the implications for the improvement of the Korean police stop and question based on the system of the USA and UK. In the USA, Stop and Frisk is that a law enforcement can frisk a suspect when they have a reasonable suspicion that a crime has been committed or the crime is being committed. In the UK, Stop and Search is the police’s authority can search people suspected of possessing weapons or illegal items such as drugs or stolen things. The study introduce the implications for the police stop and question. First, it needs to add suspicion of carrying drugs or weapons to the requirements of a suspect to prevent the abuse of authority. Second, it is proposed to legislate the search for weapons or articles related to specified offences during a police stop and question. Third, it suggests searches in the specified locality without reasonable grounds when there is a high risk of crime.
