Abstract

This study explores institutional challenges and policy implications for promoting cross-border telemedicine as a high-value-added export industry amid digital transformation. Telemedicine enhances healthcare access, reduces costs, and provides developing countries affordable access to advanced medical services, offering exporting nations significant market opportunities. However, unresolved legal and institutional barriers remain. Analyzing these challenges from private international law and trade perspectives, this research finds governments prefer unilateral liberalization via domestic laws for greater regulatory flexibility, rather than commitments under WTO's GATS. Generally, patient-protective laws in the patient's home country govern medical practices and malpractice issues, though jurisdictional rules vary. Additional institutional challenges include integration with national insurance and social security systems, effective regulatory enforcement, and clinical safety guidelines. Addressing these issues is most feasible through bilateral or plurilateral agreements. Comparative analyses of successful cases, such as the EU and Australia-New Zealand arrangements, highlight key success factors: collaboration with institutionally similar countries, explicit recognition of regulatory differences, and trust-building through ongoing cooperation. Korea should strategically select compatible partners and progressively enhance its domestic institutional capacity.
