의료부문의 ICT 융합 관련 규제의 현황과 개선과제: 원격의료를 중심으로

본 연구는 최근 들어 산업 전반에서 일고 있는 이른바 ICT기반의 4차 산업혁명 가운데 의료부문의 변화를 이해하고 특히, ICT 기반의 원격의료를 활성화시킬 수 있는 법적, 제도적인 개선 방안을 논의하는 데에 주요 목적을 두고 있다. 원격의료의 행위 및 주체의 범위, 건강보험의 보장성 여부, 개인정보 공유의 법적인 한계 및 원격의료 시행을 위한 의료장비 요건과 의료기관의 시장진입의 문제, 그리고 의료분쟁에 대한 책임성의 쟁점 등을 논의함으로써, 현재 대부분 시범사업 내지 일부 제한된 범위에서 운영되는 원격의료의 범위 확대와 그 적용 가능성을 타진해 보는 기회로서 그 의의가 있다 할 것이다. 주요 내용으로 원격의료의 일반적인 개념과 법적인 해석을 바탕으로 이러한 원격의료의 시행이 생산하는 사회적인 편익 및 부정적인 견해 등을 포괄적으로 고찰함으로써 원격의료의 활성화에 대한 정책적인 함의를 제시하고자 한다.
Abstract
Due to a wide scope of new convergence trend within healthcare field, this study focuses on the telemedicine. Since 2002 when the article of ‘telemedicine’ was firstly included, there have been massive debates on the scope of medical practices through telemedicine, technology standards, practice standards, national health insurance coverage, defining responsibilities of medical malpractice through telemedicine, and so forth. This study summarizes the issues mentioned above and tries to derive the workable suggestions so as to successfully implement the telemedicine practices which are mainly focusing on prevention and treatments of chronic diseases such as diabetes and hypertension. Additionally, a legislative framework on information security is to be considered to protect personal medical records from any possible leakage or misuse in the course of telemedicine.
