유럽인권협약 제8조의 ‘사생활을 존중할 권리’에 의거한 동성애자들의 ‘자기결정권’: 유럽인권재판소의 판례를 통한 법해석의 문제

초록

자기결정권은 헌법상의 권리이기도 한데, 그 법적 근거로 우리 헌법 제10조를 들 수 있다. 헌법재판소는 성적 자기결정권을 동성애자들에게까지 인정되는 헌법상 기본권 보장의 대상으로 보고 있지는 않다. 이와는 달리 유럽인권재판소는 동성애에 관한 법적 문제에 대해 상당히 적극적인 판결을 내리고 있다. 유럽인권재판소에 의하면, 자기결정권이란 “그 자신이 선택한 방식으로 삶을 이끌 수 있는 능력”을 말한다. 개인의 이 능력은 관련 개인을 위하여 신체적으로 혹은 정신적으로 해롭거나 위험한 성질을 포함한 활동을 추구할 기회를 포함할 수도 있다. 동성애자들의 자기결정권이 인정된다고 할지라도, 만일 그들의 성생활이 제3자에 대한 해롭거나 위험한 활동의 경우에는 “이 권리의 행사에 대하여는 무질서와 범죄의 방지, 보건 및 도덕의 보호 또는 타인의 권리 및 자유를 보호하기 위하여” 일정한 제한이 가해질 수 있다.

Abstract

The right to personal autonomy is a constitutional right, and can be cited the Article 10 of our Constitution as a legal basis. Our Constitutional Court takes quite conservative judgment about the rights to sexual auronomy. In contrast, the European Court ofHuman Rights(ECtHR) makes a significant positive judgment about the legal issues related to homosexuality. According to the ECtHR, refers to the right to Personal Autonomy is "the ability to lead their lives to the selected method." The ability of the individual may also include the opportunity to pursue activities perceived to be of a physically or morally harmful or dangerous nature for the individual concerned. Although that personal autonomy is recognized for homosexuals, if their sexual life is harmful or dangerous activity for the case of a third party, this right can be applied to certain restrictions for the prevention of disorder or crime, for the protection of health or morals, or for the protection of the rights and freedoms of others.
