초록
재난은 수많은 인명과 재산의 피해가 발생하고, 국가전체가 위기에 직면할 수도 있는 심각한 문제이기 때문에 모든 국가들은 재난의 발생을 예방하고, 재난이 발생한 경우 이를 수습하기 위한 다양한 법제를 갖추고 있다. 우리정부도 재난이 발생할 때마다 이에 대한 대비와 수습방안을 제시하며 다양한 내용의 법률이나 정책들을 제시하고 있지만 여전히 여러 가지 문제점들이 나타나고 있다. 먼저, 재난관리 조직체계와 관련하여, 재난대응과 관련한 지휘체계의 이원화, 재난관리 기구들의 기능혼선, 정보전달의 비효율성, 지방과 민간단체의 미비한 역할 등의 문제점이 제기되고 있다. 다음으로 재난관리 작용체계와 관련하여 관련 법률의 분산 및 중복, 수습중심의 재난대책 및 실질적인 교육의 미흡 등의 문제점이 여전히 노출되고 있다. 그리고 이러한 재난대응 조직체계와 작용체계의 문제는 국가배상책임의 인정여부와 연결될 것이다. 즉, 재난관리 조직체계의 불완전성이나 재난에 대응하는 시설의 시설기준 등이 적절하지 못한 경우에는 위법성이 인정될 수 있을 것이다. 또한 안전기준도 국가배상책임을 인정하는 중요한 기준이 될 것이다. 그리고 국가배상법상 책임을 강조하는 등의 필요가 있는 경우에는 개별법 상의 국가배상법상 손해배상책임조문을 규정하는 것도 고려해 볼만한 하다. 재난은 막대한 피해를 발생시키지만 그 복구과정에서 여러 가지 문제점이 드러나고 개선방안을 도출할 수 있는 기회를 제공하기도 한다. 따라서 지금까지의 재난들에서 배운 것들을 통해 실질적인 대책들을 마련하는 것이 필요하며, 예방과 대비단계에서의 법제도 및 체계에 대해 더욱 집중하고 안전에 대한 국민의 의식을 고취시키고, 재난관리에 대한 협력을 이끌어내는 것도 중요할 것이다.
Abstract
A disaster is a serious disruption of the functioning of a community or a society involving widespread human, material, economic or environmental losses and impacts, which exceeds the ability of the affected community or society to cope using its ownresources. Korea has established the Framework Act on The Management of Disasters and Safety. Disaster Management has been made at national level which is to prevent disasters and countries in order to protect citizens from harm and dangerous. But while the number of large-scale disasters, including the sinking of Sewol this time for the government and local governments see the response process, the system did not work and manual was never utilizedFirst, with regard to disaster management organization system, the dualized chain of command, complex functions of disaster management organizations, inefficiency, inefficient communication has been pointed out as a problem. Then with regard to disaster management action system, duplication of legislation, measures to resolve of the disaster, the lack of disaster preparedness trainingProblem of disaster response organization system and action system will be connected with government liability. In other words, if the fault of disaster management facility standard or imperfection of disaster management system could be recognized illegality. and safety standards is important tooDisaster management is one of the most important roles of the state. Therefore Disaster Management legal system should be careful maintenance
