본고는 맥코믹의 ‘제도적 사실로서의 법’이라는 법개념론의 의미를 해명하고, 그것의 철학적 기초와 법이론적 함의를 다각적 심층적으로 고찰한다. 구체적으로 말하면, ‘제도적 사실’ 이론에 대한 충실한 검토와 함께 ‘제도적 사실’의 존재론적 본성을 궁구한다. 그리고‘제도적 사실로서의 법’이 갖는 특성 세 가지(사실성, 규범성, 제도성)를 규명하고, 이 논제의유형적 특징과 법이론적 함의를 논한다. 맥코믹은 제도적 법이론의 제1차 목표를 법의 존재론적 테제 규명으로 선언한다. 그리고 “법(법의 제도)의 실례의 존재는 철학적 의미에서 제도적 사실의 문제이다.” 라고 주장하며, 법이 어떠한 방식으로 실재하는지를 분석해낸다. 하지만 맥코믹은 전체 법개념론을 구상함에 있어서 명시적 효력 기준을 가진 규칙을 필수요건으로 한 ‘제도적 사실로서의 법’이 갖는 한계를 인식한다. 그리고 결국 ‘제도적 사실넘어’의 법적 규범의 존재 가능성을 모색한다. 이를 통해 맥코믹은 ‘법적인 것’의 경계를확장하고, 결국 ‘제도적 규범질서로서의 법’ 이라는 확장된 법개념론으로 나아간다.
Abstract
This article investigates MacCormick’s early conception of law, “Law as institutional Facts”, focusing on its philosophical foundations and jurisprudential implication. This conception has been defined as the concrete concept which has been ontologically oriented and embodies a substantial legal system. Earlier MacCormick primarily seeks for understanding of ontological theses of law. He demonstrates the way law exist by claiming that "The existence of an instance of law(or legal institution) is in a philosophical sense a matter of institutional fact.” But MacCormick recognizes limitation of law as institutional reality in the structure of whole legal conception and explores the possibility of legal norms which transcends institutional facts. I claim that he extends the boundary of the legal, which results in practical theory of legal system.
