제도적 법이론의 주창자로 잘 알려진 맥코믹은 기존의 주요 법이론들의 한계를 보완하는 대안적인 제도적 법개념론을 제안해왔다. 구체적으로 그는 ‘제도적 사실로서의 법’과 ‘제도적 규범질서로서의 법’이라는 두 논제를 제시했다. 두 논제는 동일한 논리적 구조를 이루지만, 그 의미와 내용에 있어서는 적잖은 차이점이 있다. 따라서 양자 간의 상호 관계를 해명하고, 변화의 양상 및 함의를 분석・평가할 필요가 있다. 이러한 문제의식과 배경 하에, 필자는 우선 맥코믹의 연구 시기와 단계를 전기와 후기로 구분한다. 그리고 각 시기를 대표하는 법개념 논제를 규정하고 핵심 내용과 특징을 해명한 후, 그 이론적․실천적 함의를 분석한다. 그리고 ‘제도’에 대한 맥코믹의 관념과 제도적 용어법의 변화를 추적함으로써, 전・후기 두 법개념 논제 간의 변화 양상과 특징을 방법론적이고 실질 내용적인 두 측면에서 분석하고 평가한다. 이를 통해 필자는 두 논제들 사이의 상호 관계를 규명하고, 각각의 성격을 특징짓는다. 필자는 전・후기 법개념론의 변천을 이끈 결정적인 요인으로 두 논제를 구성하는 핵심 요소인 ‘사실(fact)’과 ‘규범적 질서(noramtive order)’라는 근본 개념의 변경으로 파악하고, 특히 그런 관점을 기초로 변화 양상과 특징 및 함의를 다각도로 규명한다. 결론적으로, 맥코믹의 전기 법개념 논제인 ‘제도적 사실로서의 법’은 존재론적으로 편향된 분석 철학적 법개념관으로서 법 전문가들의 관념과 ‘책 속의 법’을 대변한다. 반면에 그의 후기 논제이자 최종적 법개념 논제인 ‘제도적 규범질서로서의 법’은 법에 대한 시민들의 일반적 관념 뿐 아니라 사회학적 접근이 결합된 통합적 법개념관의 성격을 띤다. 특히 후기 법개념론은 ‘묵시적 규칙’과 ‘법원칙’의 가능성을 인정함으로써 법개념의 외연을 확장하기도 한다. 마지막으로 필자는 맥코믹의 전․후기 법개념론 사이의 이러한 변화에 대해 방법론과 실질적 측면에서의 근거를 들면서, ‘단절’이 아닌 ‘확장적 연속성 테제’를 주장한다. 맥코믹의 제도적 법개념론에 대한 포괄적이면서도 체계적으로 분석해내고자 한 본 연구는 맥코믹 이론에 대한 적확하고 풍부한 이해를 도울 뿐 아니라, 제도적 법이론에 대한 발전적인 후속 연구와 생산적 논의를 이끄는데 기여하리라 기대한다.
Abstract
Neil MacCormick who is well known as the initial advocator of the Institutional Theory of Law has provided an alternative conception of law, which supplements defects of previous major legal theories. His presentation of law consists of ‘Law as Institutional Facts’ and ‘Law as Institutional Normative Order’. Although these two kinds of thesis share the same logical structure, they are different in their meaning and content. Therefore, the exploration of their correlation and its implication is necessarily required. In order to carry out this task, this paper starts with the analysis of core meaning of these two concepts. In Part Ⅰ, I will demonstrate the differences between two propositions in methodological aspects and from substantial perspective by tracing the changes of his conception of ‘Institution’ and institutional terminology. Part Ⅱ seeks to establish the correlation between two thesis. MacCormick's early conception of ‘Law as Institutional Facts’, is defined as the concrete concept which is ontologically-oriented and embodies the notion of legal professionals. The later thesis, ‘Law as Institutional Normative Order’, on the other hand, embodies a philosophical and sociological conception as well as a general conception of law. In Part Ⅲ, I will briefly point out the theoretical and practical implication of MacCormick's destination-conception of ‘Law as Institutional Normative Order’ in the context of multi-layered and dynamic characteristics of modern legal system. Finally, I will analysis of the development and changes in MacCormick’s Institutional Conceptions of Law, especially focusing on the fundamental concept of ‘Facts’ and ‘Normative order’ which consist of two thesis. In conclusion, I claim that the right understanding of these chances is ‘the Expansive Continuity Thesis’.
