2017년 12월에 실시되는 제19대 대통령선거는 1987년헌법에 따라 실시되는 7번째 대통령선거가 된다. 30년간에 걸쳐 수차례 실시된 대통령선거를 통하여 계속 문제점으로 지적되어왔던 것이 바로 결선투표제였다. 이제 이에 관한 헌법해석론과 입법론을 명확히 정리하고, 이를 바탕으로 발전적인 시도를 할 때가 되었다. 첫째, 역대 헌법은 대통령선거의 당선자결정방식을 분명히 규정함으로써 이것이 대통령선거체계의 핵심사항, 즉 헌법사항임을 보여주었다. 역대 헌법상 채택된 당선자결정방식은국민이 대통령을 직접 선출하는 경우와 국회 등에서 간선하는 경우에 따라 달랐다. 전자의경우는 상대다수결 선거방식을, 후자의 경우는 절대다수결 또는 가중다수결(3분의 2 이상의 찬성) 선거방식을 택하였다. 둘째, 현행 헌법은 대통령선거에 있어서 상대다수결 선거방식을 전제로 하고 있다고 본다. 그러므로 절대다수결 선거방식을 전제로 한 결선투표제의 도입은 개헌절차를 거쳐야한다. 셋째, 현행 헌법에서도 대통령의 민주적 정당성을 확보하고 정당 간 정치적 경쟁, 선거권자의 선택의 자유 등을 충실히 확보하기 위하여 결선투표제가 도입될 필요가 있다. 그러한 결선투표제의 구성은 통상의 보완투표제를 기본으로 하되, 1차 선호투표의 당선자결정방식을 상대다수결 선거방식으로 하는 것, 즉 당선에 필요한 최저기준(threshold)을 45%의 득표율 또는 10%의 격차를 가진 40%의 득표율로 하는 것으로 설계하였다. 이는 2회투표제를 사실상 단번에 즉각적으로(instantly) 실시하는 효과를 갖는다는 점에서 단판결선투표제 (Instant Runoff Voting System, IRV)라 할 것이며, 그 내용은 상대다수결 보완투표제라고 할 수 있다. 마지막으로, 국가적 차원의 최대선거인 대통령선거에 결선투표제를 도입하기 전에 먼저지방자치단체장의 선거에 결선투표제를 실시하는 것이 안전하다고 본다.
Abstract
The 19th presidential election to be implemented on December in 2017 will be the seventh one that will be carried out on the basis of the Constitution of 1987. It is a runoff voting system that has been pointed out one of critical issues on the presidential elections implemented several times for 30 years. Now it is time to clarify some constitutional interpretational questions and make an evolutionary attempt to legislate for this. First, the former Constitutions of Korea showed that an electoral formula is a core matter of the presidential election system through their relevant provisions. Historically, the electoral formula of president was plurality in the case of popular(direct) vote; majority or two-thirds of valid votes in the case of indirect vote. Second, in the current Constitution, plurality is the electoral formula of the presidential election system. Thus a two-round system with majority formula must be introduced through the procedure of constitutional amendment. Third, even in the current Constitution, it is necessary to set a runoff voting system in order to ensure the democratic legitimacy of the President, political competition among political parties, and the freedom of choice of voters. Such a system is basically a supplementary voting system with plurality formula i.e. a threshold of 45 percent of the votes or 40 percent of the vote with 10 percent margin. This system is an Instant Runoff Voting System(IRV) in that it has the effect of implementing virtually two-round system at once and is also called as a supplementary voting system with plurality. It is safe to carry out the runoff voting system in the local elections before its introduction to the presidential election at a national level.
