형사소송법은 전자적 증거(Electronically Stored Information, ESI)의 압수 대상성을 반영한 압수․수색 조항을 마련하고 있으나 아직 ESI에 대한 증거조사나 증거개시 문제에 대해서는 구체적인 조항 마련이 늦어지고 있다. 실무상 사실인정은 대다수 디지털 증거에 의하여 이루어지고 있다고 해도 과언이 아니다. 이와 관련해서 미국식 eDiscovery 제도 도입의 중요성을 강조하는 문헌 다수 등장하고 있으나 민사소송과 같이 대립적인 당사자 구조 하에서의 증거조사 방식에 치우쳐 있다는 점에서 공익적인 측면이 강한 형사소송에 그대로 반영할 수 있을 지는 의문이다. 이하에서는, 이와 같은 eDiscovery 도입을 위한 선행조건으로 ①데이터에 대한 접근가능성을 제고하는 방안, ② 그에 상응한 ESI 처리 전문가의 필요, ③ ESI 유출사고 방지를 위한 보안 정책마련, ④ 메타 데이터(meta data)등을 위변조 적발 전문가의 필요, ⑤ 특히 과도한 소송비용 부담 문제 해결 및 제도적 지원 방안을 집중 검토하였다. 나아가 기술적 요구사항으로 ① 포렌식 건전성 확보방안, ②데이터의 자동화․지능화․시각화 가능성, ③ 예측 부호화의 적용 가능성에 대해 언급하였다. 향후 이러한 선제적, 기술적 요구사항을 고려하여 형사소송절차에서 어떤 범위 에서 어떤 방식으로 eDiscovery 절차를 도입할 것인지에 대한 신중한 논의가 필요한 시점이다.
Abstract
The Criminal Procedure Act provides for seizure and search provisions that reflect the object of seizure of Electronically Stored Information(ESI). However, there is a delay in preparing specific provisions for the investigation of evidence or disclosure of evidence for ESI. In practice, the finding of facts is mostly done by digital evidence. In this regard, there are a number of documents that emphasize the importance of introducing an American-style eDiscovery system. However, it is questionable whether the American-style system, which is biased toward evidence investigation under the structure of opposing parties, such as civil litigation, can be applied to criminal proceedings with a strong public interest. This is because the public interest such as the right to a speedy trial for the accused as well as the issue of privacy should be emphasized. In this paper, as prerequisites for such eDiscovery introduction, ① measures to improve access to data, ② the need for ESI processing experts, ③ preparation of security policies to prevent ESI leaks, ④ the need for forensic experts to detect forgery and falsification, ⑤ especially the problem of excessive procedural cost burden, and institutional support systems were intensively reviewed. Furthermore, as technical requirements, ① measures to secure soundness of forensics, ② possibility of data automation, intelligence, and visualization, and ③ applicability of predictive encoding were mentioned. Considering these preemptive and technical requirements in the future, it is time to carefully discuss how and to what extent the eDiscovery procedure will be introduced in criminal proceedings.
