Abstract
Upon the outbreak of Covid-19 disease worldwide, the practice of the onlineproceding has rapidly spread throughout the courts around the world. To provide legalgrounds to make wide use of the online remote hearings both in civil and criminalprocedings, U.S. enacted the Coronavirus Aid, Relief, and Economic Security Act(hereinafter CARES ACT) in March, 2020 and U.K. pased the Coronavirus Act in thesame month, as an emergent response to the pandemic. While some American cases inthe past years showed narow interpretation of the defendant's confrontation rightlimitng the availabilty of the remote hearing in the criminal cases, curent cases arechanging to alow more remote hearings in various criminal procedings. Regarding thecivil cases, almost al of the U.S. state courts have embraced the online remote hearingsand considerable number of states courts are handling specifc cases by ODR, whichlimits face-to-face contacts in setling disputes. The judicial practice in U.K. is alsoactively utilzing the remote video and/or audio hearing by using livelinks both in civiland criminal maters. U.K courts are obliged to alow public aces to the remotehearings either by permiting media representatives to log-in or livestreaming online. Compared to the quick response to the pandemic of the U.S. and U.K. courts from beginning of the pandemic, Korea has ben quite conservative to adopt the online remotehearings. Therefore the curent legislations and positve experiences regarding broaderuse of the remote hearing in the virtual court, and alowing public aces by onlinelivestreaming, ned to be considered in amending our procedural statutes andimplementing online court proceding. In aditon many U.S. state courts have adoptedODR in disputes such as smal claims, family maters, eviction claims, and traficviolations, thus provide beter aces to justice and also contribute to resolve casebacklogs. Given that the basic structure of ODR is designed to minimize human contact,ODR would be the efective tol of the future dispute setlement in that it could servethe public interest in protecting public health. In this regard Korean courts should tryto sek resolution of specifc cases adopting court ODR, which should be user-friendlyand technology based dispute setlement to enhance public aces to justice.
