Abstract
Online Dispute Resolution (ODR) has been recognized as a rapid, efficient, and convenient method of dispute resolution that can contribute to ensuring access to justice. ODR, which belongs to the dispute resolution system that includes litigation and Alternative Dispute Resolution (ADR), utilizing IT, requires a multifaceted approach for its promotion. Especially for the promotion of ODR in the private sector, unlike public ODR, such as court-connected ODR, it is necessary to ensure procedural fairness as a dispute resolution process through institutional measures. Various methods of regulating ODR are possible depending on how ODR is viewed and the goals for its promotion. In the case of Japan, the introduction of IT into the dispute resolution system has been relatively slow, but since 2019, based on legislation aimed at digitalizing society as a whole, Japan has extensively amended relevant laws and established and implemented policies in connection with existing dispute resolution systems. Despite the ODR Promotion Committee continues to review specific ways to activate ODR after its pilot project, a comprehensive and systematic discussion is expected to continue to significantly improve access to justice. To promote private ODR in Korea, there is a need to first raise awareness of ODR in society, and since an online platform is necessary, there must be technical support and regulations regarding the platform’s convenience and security. Additionally, there is a need to ensure the independence and neutrality of platform operations as well as transparency in operating. It is also necessary to discuss the use of AI for the continuous development of ODR. For ODR to function as an appropriate dispute resolution mechanism, in addition to creating the necessary environment, procedural fairness must be ensured. Securing fairness will contribute to the reliability of ODR and the validity of its outcomes, thus helping to ensure access to justice. On the other hand, to address the shortcomings of private ODR, which have been pointed out in terms of effectiveness, the enforceability should be considered. To provide enforceability, procedural fairness and substantive justice must be guaranteed. This ultimately leads to issues of fairness, independence, and competence in ODR procedures, and it will be necessary to establish legislation in this regard.
