감염병 위기상황에서 의료자원의 공정한 분배를 위한 의사결정과 민주적 거버넌스

우리 사회가 전례 없이 도전받고 있는 심각한 갈등상황으로부터 위기극복을 위한 바람직한 의사결정을 위해 중요하다고 판단되는 자원분배 결정과 관련된 기본원칙과 조건들에 대해 논의가 활발하게 이루어지고 있다. 의료자원의 공급이 현저히 부족한 경우 그 배분적 결정은 의료자원을 적절히 제공받지 못한 사람들로부터 정당한 항의가 제기되고 사회적 연대의식에 대한 갈등을 야기할 수 있다. 의료자원에 대한 암묵적인 배분(implicit rationing)은 이미 이루어지고 있던 숨겨진 차별과 배제가 작동하여 사회경제적 혹은 다른 차원에서 더 나쁜 처지에 있는 이들에게 부당한 불이익을 줄 수 있다. 새로운 정책결정시 공정성과 형평성을 확보하기 위해서는 의료자원의 분배기준은 명확하고 강력하고 권위있는 국가차원에서의 지침이 필요하다. 감염병예방법에 공급의 우선순위 등 분배기준을 정해야 한다는 내용과 아울러 이러한 분배기준에 따른 전국적으로 통용되는 기본지침을 정한다는 명시적인 규정을 마련할 필요가 있다. 코로나19 대유행이 가져온 상황은 단순히 의학적 상황 뿐만 아니라 사회적·경제적·심리적 위기상황의 복잡성을 가지고 있다. 우리나라의 경우 코로나 위기상황에서의 의사결정이 '과학 방역'이 아닌 '정치 방역'이었다고 지적이 있었다. 과학자문에서 지향해야 할 가치 중의 하나가 과학적 근거나 지식이 언제든지 검증 가능한 상태에 놓이도록 하는 시스템을 만드는 것이다. 코로나19 대응과정에 공식화되고 체계화된 과학자문기구가 부재하거나 몇몇의 전문가에게 과학자문의 요청이 집중되거나 소수의 정치적 성향의 전문가의 관점에 과도하게 치우치는 실정에 있었다는 점에서 정부기관과 독립적인 그러나 협업적인 관계를 가지는 기구로서 그 운영의 과정에서 투명성과 개방성(transparency and openness)을 가지고 있는 체계적인 과학자문기구의 설립이 필요하다. 감염병예방법상 감염병관리위원회 내에 감염병 위기시 과학자문기구로서 역할을 할 수 있는 별도의 전문위원회를 신설하는 방안을 제안한다. 지속적인 감염병 위기 상황을 전제로 한다면 가능한 한 공개적이고 투명한 과정을 통해서 각기 다른 이해관계자의 의견을 수렴하는 과정을 통해서 지침을 마련하여야 하고, 각각 감염병 특성에 따라 특별한 상황에서 가이드라인을 적용해야 할 경우 언제 어떻게 우선순위를 정하는 공론화 과정을 거치고 이러한 의사결정에 어떠한 과학적 조언과 자문에 근거를 두어 충분히 투명한 과정을 통해 정할 것인가에 대한 시스템이 마련되어야 할 것이다. 이를 위하여 감염병예방법 시행령 제3조의 감염병전문위원회의 회의에 다양한 이해관계자의 참여가 이루어져야 할 필요가 있으며, 위원회의 회의록이 공개되어야 하는 등의 공개적이고 투명한 시스템 구축을 제안한다.
Abstract
It is important for a desirable decision to overcome the crisis from the serious conflict situation in which our society is being challenged unprecedentedly. First of all, discussions on the basic principles and conditions related to resource distribution decisions should be actively discussed. One of the important principles and values of ethical frameworks is fairness and equity. If the supply of medical resources is significantly lacking, the distribution decision is a legitimate protest from those who are not properly provided with medical resources. Therefore, if the demand for rare medical resources exceeds the supply, it is practically difficult for all doctors to solve the medical field. In order to secure fairness and equity in the new policy decision, the distribution standards of medical resources are required at a clear, powerful and authoritative national guideline. The development of guidelines that can be applied fairly and consistently should be made. In the corona 19 response process, there were no formalized and systematic scientific advisory organizations, and some experts were concentrated on the request for scientific advisory or excessive biased to the perspective of a minority political tendency. As an organization that has an independent but collaborative relationship with government agencies, it is necessary to establish a systematic scientific advisory organization that has transparency and openness in the process of operation. The decision -making process of rare resource distribution should be disclosed based on an explicit and legitimate standard and should be the theme of communication that is accessible to the general public. Our society must prepare guidelines through the process of collecting the opinions of different stakeholders through open and transparent processes, and each of which must be applied in a special situation according to the characteristics of infectious diseases. A transparent decision -making process system must be provided.
