Abstract

Games encompass technological, cultural, and artistic elements and are subject to various protective and regulatory legal frameworks. The gaming industry consists of both businesses and users, yet the Game Industry Promotion Act lacks concrete protective measures for users’ rights beyond declarative provisions. While the rating classification system helps address information asymmetry, it remains insufficient in safeguarding user rights. With the 2023 amendment to the Culture and Arts Promotion Act recognizing games as a form of cultural art, there is a growing need to reconsider the role and status of users. To prevent unfair gaming services from harming users and to foster industry growth based on fairness and trust, it is essential to enshrine user rights within the Game Industry Promotion Act. Ensuring transparent and fair services is a crucial task for the industry's sustainable development.
