Abstract
Sasong, which is categorized as a civil case, is a trial that presents and solves a personal issue or problem through written documents. The document that is turned in to the government office for this purpose was called Soji. A trial could only be started when a Soji that follows a certain type of format was turned in. The Soji that the woman turned in could be measured quantitatively as it utilized a certain type of titles such as Ssi and Sosa. Through the analysis of several sources, it was confirmed that 10% of the Soji was turned in by the woman, and among those 10%, approximately 20% was confirmed to have been written in Korean. The steps of the trial only progressed through written documents and thus required a knowledge in law and writing to win the case. Consequently, the commoners who were not educated in language had to ask others with past experiences with trials for consulting about law and to write for them. The trial introduced in this paper is caused by Sang-ju region’s territorial problems, and the plaintiff is Jang-Sosa, while the defendant is a person named Go-chum-ji. Jang-Sosa, who was a female commoner, turned in all three pieces of Soji into the government office of the village. Two pieces were written in Korean, and the other piece was written in Chinese. If the content of the Korean and Chinese Soji were compared, it is evident that the Korean Soji was in a narrative and colloquial form. Jang-Sosa’s thoughts and emotions are reflected in the Korean Soji. When an explanation for a key evidence source was needed, Jang-Sosa turned in a Korean Soji. Although female commoners were predicted to be unable to write Korean, they could read and through these means, they were able to express their intended thought. Thus, the prominent reason as to why Jang-Sosa wrote a Korean Soji was to express her thoughts clearly. On the other hand, the Chinese Soji was written in a depersonalized and formulaic manner. The people who did not learn language properly would not have been able to deliver their thoughts and meanings through a Chinese Soji. It was confirmed through the Korean Soji that Korean was the only and perfect way of communication to com-moners, especially female commoners, who could not uti-lize Chinese literacy.
