Abstract

This study examines the sociocultural dynamics surrounding Indonesia's "Village Law" through an analysis of how the state and Bali's customary law communities compete and compromise. It aims to analyze the underlying tensions between a state that "intervenes" and a tradition that "negotiates" within the national vision of "Unity in Diversity." According to the 2014 Village Law No. 6, customary villages must choose either administrative or customary village status in order to obtain legal recognition and financial support from the government. However, in Bali - where both systems coexist - the 2019 Bali Provincial Regulation No. 4 was enacted to safeguard community autonomy and ensure a certain legal status of customary villages. Based on this regulation, the Majelis Desa Adat (MDA, Council of Customary Villages) was established, empowering it to reinterpret customary law. As the MDA began revising Balinese customs and norms, internal criticism emerged that it functions as a tool of governmental "administrative control" and as the state's "agent." Meanwhile, ahead of the 2024 presidential election, the amendment of the Village Law reignited debate over whether it serves as an instrument of central control limiting village autonomy. Nonetheless, in practice, Bali's Provincial Regulation No. 4 continues to operate as the primary normative basis, superseding the national Village Law. Even as the MDA reshapes Balinese traditions into standardized, modern frameworks aligned with state intervention and contemporary demands, the enduring ideological core of Balinese society - customary law - remains and will persist.
