미군정기 ‘서울시헌장’의 재발견 - ‘지방-국민국가-동아시아’의 구조와 긴장 -

이 글은 미군정기 ‘서울시헌장’을 주로 다룬다. 서울시헌장을 기초로 서울은 대한민국에서 유일한 특별시가 되어 지금까지 이어지고 있다. 그런데 최근까지 서울시헌장의 영문본만발견되었을 뿐, 국문본은 발견되지 않았다. 종전에는 서울시헌장을 실패한 지방자치규범으로평가하고, 그 실패 원인을 좌우의 대립이라는 이데올로기적 요인으로 귀속시켜 왔다. 이 글은 서울시헌장 국문본의 존재를 확인하고, 이를 법적 관점에서 면밀히 분석하였다. 그리고서울시헌장이 이를 둘러싸고 있는 제반 국내․국제 환경과 어떻게 상호작용했는지, 그런 상호작용 속에서 서울시헌장이 어떻게 작동, 변질되었는지 등을 구조적․동태적 관점에서 분석함으로써 서울시헌장의 역사적 맥락이나 위상을 ‘지방-국민국가-동아시아’ 질서의 연계구조에서 재정립하고자 하였다. 한편 서울시헌장을 매개로 한 서울특별시 정책의 실패 원인을 국내 정치 투쟁이나 이데올로기적 요인이라는 단일하거나 결정적 인자로 귀속시키는 것이타당한지 여부도 비판적으로 재검토하였다.
Abstract
This paper reviews mainly ‘Charter of the City of Seoul’(hereafter Charter) during the American Military Occupation in Korea. With the Charter, Seoul became the only special and independent city in Korea and has came to this day. But until recently, only the english version of Charter was found and no korean version has been found. In the past, the Charter was regarded as a failure and the cause of failure was attributed to ideological factors such as strong conflict between the leftist and the rightist. This paper first identifies the existence of korean version of the Charter and analyzes it closely from legal point of view. And analyzes in a structural and dynamic perspective how the Charter interacts with the various domestic and international environments around it. Furthermore, aims to reestablish historical context and status of the Charter under the structure of ‘Local/Nation-State/East Asia’. On the other hand, this paper reviews critically whether it is appropriate to attribute the failure of special and independent Seoul plan through the Charter to a single factor, for example, political power struggle or ideology.
