Abstract

Jeong Yakyong, who was exiled to Gangjin, deeply studied the “Rites of Zhou,” which preserved the core principles of the Yao-Shun political system. Dasan believed that it was important to preserve the spirit of the land tax system, which was the core of the Yao-Shun ideal politics, select capable officials, strictly evaluate their performance, and reform the Rouxing(肉刑, physical punishment) to suit the realities of the time. In particular, the judicial system that valued human life, known as “ho-saeng-ji-deok,” was the symbol of the Yao-Shun politics. Since the early Joseon Dynasty, all forms of physical punishment except capital punishment had been abolished. Additionally, even in cases of serious crimes, the process of deciding on capital punishment must be conducted with the utmost caution. Dasan studied Joseon’s case law on capital punishment and analyzed numerous judicial precedents from the Qing Dynasty, ultimately reaching the following conclusion: The Qing Dynasty’s judicial system, characterized by harsh punishments, lack of thorough deliberation, and a disregard for human life, resulted in ten times more heinous crimes than in Joseon. Then, who can truly be said to have achieved the benevolent rule of Yao and Shun? Dasan argued that Joseon, which not only abolished cruel punishments such as amputating leg muscles or burning with fire but also maintained a tradition of leniency by commuting capital crimes to exile or fines, was the true heir to the civilized competition.
