Abstract

In the Joseon Dynasty, bobang(保放) was a temporary release granted through bosu(保授) in cases like family bereavement[親喪], extreme weather, or minor offenses. Sometimes a chaji(次知) could take the prisoner’s place[代囚]. Once the reason ended, the prisoner was recalled for formal processing. While there are similarities and differences between bobang and the modern bail system[保釋], a key distinction is that modern bail typically requires a monetary deposit[保證錢], whereas in bobang(保放), a chaji(次知) took responsibility instead. Moreover, while modern bail[保釋] can be denied if the defendant is deemed a flight risk, Joseon officials used the bosu(保授) system to prevent escape. Medical-related bobang was the most common form, and by the reign of King Jeongjo, the procedure had become simplified. It was often used by yangban(兩班)) prisoners as a means to avoid imprisonment. In cases of financial crimes—such as failing to deliver tribute goods[進上物], hwangok(還穀) or tax grain[國穀], segok(稅穀)—offenders were temporarily released to complete repayment. This use of bobang for debt collection[徵債] reflects the fiscal nature of the late Joseon period. As part of prison administration, prisoners were temporarily released[保放] before punishment[刑治] and recalled[還囚] when it was time to carry it out. Bobang was also used during prison cleaning or repairs. Bobang was implemented under two conditions: bosu(保授) and chaji(次知). Bosu placed the prisoner under watch at a set location, while chaji detained another person to ensure obligations were quickly fulfilled. Bosu placements[保授處] were supervised at trusted locations near the Jeonokseo(典獄署) or Uigeumbu(義禁府). Chaji included the prisoner’s wife, parents, siblings, slaves, or hired substitutes. In the late 17th to 18th centuries, many chaji were woman — such as wife, mother, or female slave. When only ‘chaj(次知)’ was recorded, it likely referred to a hired person. After King Jeongjo’s reign, detaining family members like legal wife[正妻] as chaji was effectively abolished. Problems with bobang included prisoners escaping during release, prolonged detention of chaji until full debt repayment, and arbitrary use of bobang by prison officials or guards. Using family members — such as the legal wife[正妻] — as chaji(次知) often proved less effective than expected. In the reign of King Gojong, it became legal to detain gadong(家僮) as chaji for the collection of public debts. Partial repayment sometimes led to bobang, but when the debt was large, chaji was ineffective. Bobang reflects the judicial, administrative, social, and economic conditions of the late Joseon period.
