갈등관리제도에 대한 일선 행정기관 갈등관리 담당자의 인식에 관한 연구

이 연구는 갈등예방과 해결을 위한 갈등관리제도의 운영에 대해 일선 행정기관 갈등관리 담당자의 인식에 주목하여, 갈등관리제도의 운영상의 문제점을 찾고 갈등관리제도의 개선과 운영 내실화를 위한 제도적 보완책을 모색하기 위한 연구이다. 이를 위해 일선 행정기관의 갈등관리 담당자들을 대상으로 한 인식조사를 통해 제도운영에 영향을 미치는 요인을 제도의 상황적합성, 비법률적 환경의 적정성, 법령의 명확성이라는 정책집행의 관점에서 분석하였다. 분석 결과, 제도의 정합성과 효과성을 강조하는 제도의 상황적합성, 개인의 전문성과 제도시행기관의 역량을 강조하는 비법률적 환경의 적정성에 대해서는 대체로 긍정적인 인식을 하고 있으나 제도운영에 필요한 인력 및 재원과 조직의 의사결정 역량을 중요시하는 법령의 명확성에 대해서는 아직 미흡하다는 인식을 하고 있는 것으로 나타났다. 또한, 개인의 전문성, 제도시행기관의 역량, 외부환경관리 역량이제도운영의 효과성에 대한 유의한 영향요인으로 나타났다. 분석 결과는 향후 갈등관리업무프로세스의 개선과 교육훈련을 통해 제도운영의 효과성에 대한 공감대를 제도의 활성화로 연계시켜야 하며, 제도의 상시 점검과 평가체계 구축 및 활용을 위해 현행 규정을 개정하여 제도시행기관의 역량을 강화할 필요가 있음을 보여준다. 또한, 인력 및 재원조달에 대한 규정이 거의 없다는 점에서 향후 갈등관리제도의 활용도 증가에 대비하여 규정 개정을 통해 전문인력 양성, 재량권을 침해하지 않는 범위 내에서 예산 및 경비 지원방식의 상세화가 필요함을 시사한다.
Abstract
This study aims to find problems in the operation of conflict management system throughout an examination of recognition of public employees and exploration of institutional alternatives to improve the system and its substantiality. From a policy implementation perspective, it analyzes factors affecting the operation of the system in a way that classifies the factors into three critical factors, including contingency of institution, adequacy of nonstatutory environment, and clarity of statute. As a result, public employees' recognition of the contingency of institution which measures coherence and effectiveness of institution, and the adequacy of the environment which primarily looks at individual professionalism and capability of agencies is positive. In contrast, their recognition of clarity of statute that measures resource availability and decision making capability appears to be somewhat negative. In addition, professionalism, capability of agencies, and environment management capability have significant effects on the effectiveness of conflict management system. Findings imply that the system has to be vitalized based on a better understanding of the effectiveness of conflict management system through the improvement of a conflict management work process, and an education and training program. Findings suggest the capability of agencies needs to be reinforced by emphasizing a monitoring and evaluation system. Likewise, a statute amendment is required to specify a professional manpower system and to secure budget for its vitalization.
