미국 연방정부의 고위직 임용체계와 인사청문제도에 대한 사례연구

초록

한국의 역대 정부는 물론 현 정부에서도 고위공직자 임명과 관련한 불신이 해소되지 못하고 있고 이에 대한 문제 제기가 많았었다. 고위공직자 임명과 검증 등에 관한 국내외 논의는 많은 편이나, 그에 걸맞은 정부차원의 구체적인 제도설계와 개선조치 등은 제대로 이뤄지지 못하고 있다. 따라서 본 연구의 목적은 미국의 고위직 임용체계 등을 심층적으로 고찰하면서 고위직 임용체계와 인사청문제도 등에 대한 자세한 분석을 해보는데 있다. 이렇게 함으로써 한국에서의 정책적 시사점을 찾아보고 개선방향을 모색해볼 수 있을 것이라고 기대한다. 이를 위해 본 연구는 우선 미국 연방공무원의 임용체계와 고위직의 임용과정 등을 하나하나 살펴본 뒤, 고위직 후보자에 대한 대통령의 지명과 상원의 인준 기능 간의 역학관계 등을 분석하고자 한다. 아울러 관련된 임용 및 인준제도 등을 평가하고, 마지막 부분에 미국제도와 한국제도를 개괄적으로 비교하면서 시사점을 찾아보고자 한다.

Abstract

There is a high level of disappointment and distrust about political appointments in the current and previous Korean governments. Political appointments and the vetting process have been discussed frequently in the Korean government, but no significant reformative actions have taken place in terms of system design and its improvement. The purpose of this study is to analyze the employment of government executives in the American federal government and the Senate confirmation hearing system and find out some possible lessons for the Korean government. In other words, this study expects to find meaningful policy implications for the Korean government and the direction for further improvement of political appointments in the Korean government. In order to do so, this study first reviews the employment of government executives and the political appointment process in the American federal government, followed by an analysis of the dynamics of the American President’s nomination of political appointees and the subsequent Senate confirmation hearing as well as an evaluation of the employment system for higher-level government officials and the Senate confirmation hearing system. After that, this study compares the American and Korean systems on the issue of political appointments and legislative hearing processes and searches for policy implications and opportunities to further develop political appointments and the legislative hearing process.
