This article focuses on the military justice system in Korea by general point of view. Thus, this paper analyzes the concept, the legal ground, the ideology, and the necessity of the military justice system in Korea. Military justice is the body of laws and procedures governing members of the armed forces. Military justice is distinct from the imposition of military authority on a civilian population as a substitute for civil authority. This condition is generally termed martial law, and is often declared in times of emergency, war, or civil unrest. The constitutionality of the law and the violation of the constitution are brought up the military justice. Article 110 of the Constitution of Korea provides the legal basis for the military justice system. Under Article 110, military courts are established as a special court with the jurisdiction over matters of military law. In conclusion, under Korea this paper proposes the institutional necessity of the military justice system.
