남북 보건의료 협력에 관한 법적 검토: 감염병 문제를 중심으로

오늘날 국제협력은 국가들 간의 연대를 함축하지만 국가주권의 포기 또는 양도를 요구하기에 여전히 불충분하게 인식되고 있다. 대표적인 감염병 관련 국제규범으로서 「국제보건규칙(IHR 2005)」이 존재하나 국가주권 및 이익과의 충돌, 규범의 불명확성 등 효과적인 규범의 준수 및 이행의 담보가 문제점으로 지적되고 있다. 그럼에도 국가가 국제협력 의무를 성실히 준수하지 않는 행위는 국제사회에서 분명 정치적·외교적 비난의 대상이 될 수 있으며, 특히 보건협력 분야에 있어서 그 비난의 강도는 더욱 클 것이다. 최근 교착상태가 지속되고 있는 남북관계 개선을 위해서는 대북제재 속에서 국제사회의 우려를 불식시키고 설득해 나갈 수 있는 북한 주민에 대한 인도주의, 남북한 및 (가칭)통일한국(統一韓國)의 인간안보 등 非정치적인 성격을 지닌 보건의료 협력 논의가 시의성 있게 이뤄져야 할 것이다. 감염병의 초국경적(超國境的) 특성상 국가 간 공동대응을 기반으로 한반도 생명공동체로서 남북 보건협력은 시대적으로 더욱 요구되고 있으며, 감염병 공동대응은 일방이 아니라 반드시 상생(相生)의 관점에서 접근해야 하는 사안이다. 따라서 보건협력은 한반도가 지닌 분단국의 특수 상황 가운데 ‘공존적’(共存的) 협력의 차원에서 논의되어야 한다. 단순히 상호 간의 실체를 인정하는 병존(竝存)이 아닌 상호 신뢰와 협력을 기반으로 하는 존재의 인정으로서 ‘신뢰’와 ‘협력’이라는 필수 요소를 전제로 해야 할 것이다. 과거 동서독이 「보건의료협정(1974)」을 통해 공존적 보건협력을 이루었듯이, 통일한국을 대비하는 우리에게 있어서도 ‘한반도 생명공동체’로서 남북한의 공존적 보건협력은 한반도의 평화와 번영을 실현하는 핵심 동인이 될 것으로 사료된다.
Abstract
International cooperation today implies solidarity among countries, but is still insufficiently recognized to demand the abandonment or transfer of state power. The International Health Regulations (IHR 2005) exist as a representative international norm for infectious diseases. However, security for effective compliance and implementation of norms, such as conflicts with state and interests, and uncertainty of norms, is pointed out as a problem. Nevertheless, the state's failure to faithfully comply with its obligations for international cooperation can certainly be subject to political and diplomatic criticism in the international community. In particular, the intensity of criticism in the field of Health Cooperation will be even greater. In order to improve inter-Korean relations, which have been stalled recently, discussions on humanitarian and security cooperation should be made in a timely manner to dispel and persuade international concerns under sanctions against North Korea. Due to the cross-border nature of infectious diseases, Inter-Korean Health Cooperation is further required based on joint response between countries, and joint response to infectious diseases must be approached from a win-win perspective. Therefore, Health Cooperation should be discussed in terms of ‘coexistential’ cooperation among the special situations of the divided countries on the Korean Peninsula. Just as East and West Germany have achieved Coexistential Health Cooperation through the 「Health and Medical Agreement(1974)」 in the past, it is believed that Coexistential Health Cooperation between Couth and North Koreas will be a key driver of peace and prosperity on the Korean Peninsula.
