Abstract

In accordance with all elements rule and territoriality principle applied in determining patent infringement, the act of domestically producing a having-all-elements product (“finished product”) is recognized as direct infringement. A product that is missing one or more parts required to be a finished product, or parts where all component parts have been produced but not assembled (combined) (collectively, “unfinished product’) is domestically produced and then exported, and thereafter is simply assembled (completed) and used abroad. In this case, neither direct infringement nor indirect infringement is recognized according to the all elements rule and territoriality principle. The target “Bongphapsa” decision presented a very unusual legal principle (“Bonghapsa jurisprudence”) that included domestic production of unfinished products as a direct infringement of Korean patent rights (conditional on complying with four special requirements). The four requirements of Bonghapsa jurisprudence are (1) all parts or major component semi-finished products requirement, (2) one entity plus scheduled assembly requirement, (3) extremely simple assembly requirement, and (4) identical effect requirement. In order to develop a thorough understanding of the Bonghapsa jurisprudence and enhance the ability to apply it to other cases, this paper attempted to practice applying the four requirements to various scenarios. As a result of the exercise, this paper has arrived at the following conclusions. First, the Supreme Court requested that assembly be “extremely” simple, considering that the Bonghapsa jurisprudence is an extremely exceptional one that recognized an exception to an existing important principle. In the target Bonghapsa case, assembly (formation) took only 2 seconds. Therefore, the Bonghapsa jurisprudence should not be applied to assembly beyond such an extremely simple level. An assembly is not an extremely simple when separate training and/or specialized equipment is necessary. A distinction must be made between simple assembly and extremely simple assembly. Second, because the Bonghapsa decision is an unusual one that recognizes an exception to the all elements rule, the court should not recognize additional exceptions to the exception. Even bigger exception should not invalidate the principle. Third, it can be argued that a stronger legal doctrine is needed because the Bonghapsa jurisprudence does not sufficiently protect patent rights. However, the place to reflect or resolve the claim should be the National Assembly, not the court. It is up to the National Assembly to introduce an (additional) exception to the existing important principle.
