읍면동 법적지위 전환문제의 개선방안 연구

본 연구의 목적은 읍면동 전환 과정과 관련된 문제에 대한 적절한 해결방안을 제시하는 데 있다. 이를 위해 본 연구는 읍면동 전환의 사례를 살펴보고 사례와 연관되는 이슈를 도출하여 이에 대한 적절한 해결책을 제안하였다. 우선 읍면동의 전환사례를 유형별로 검토하고 관련 이슈를 도출하였다. 사례에서 도출되는 쟁점은 읍면동의 구분필요성, 읍면의 위상차이, 읍면의 농어촌 특례, 법적규정의 미비, 행정안전부의 승인권 보유인 것으로 나타났다. 쟁점의 해결을 위해 본 연구가 제시하는 방안은 읍면동 구분의 축소와 폐지, 특별법을 통한 농어촌 특례문제의 해결, 관련 법령의 정비, 전환 승인권의 광역자치단체 이관으로 요약할 수 있다.
Abstract
The purpose of this study is to suggest appropriate solutions for the problems related to the transition process of the EupMyeonDong(submunicipal level divisions). To this end, this study examines the case of EupMyeonDong conversion, drew up issues associated with the case, and proposed appropriate solutions for it. First of all, the cases of transition in EupMyeonDong were reviewed by type and related issues were drawn. Issues derived from the case were found to be the need to distinguish EupMyeonDong, the difference in status of EupMyeon, the special favor of farming and fishing villages, the lack of legal regulations and the right to approve them by the Ministry of Public Administration and Security. The strategies presented by this study can be summed up as the reduction and abolition of the division of EupMyeonDong, the resolution of special issue of farming and fishing villages through the special law, the revision of related laws, and the transfer of the right of approve the conversion to metropolitan and provincial governments.
