재난관리 분야에서의 중앙-지방 간 협력체계 발전 방향: 「지방자치법」과 「재난 및 안전관리 기본법」 간의 논의를 중심으로

Abstract

This study aims to analyze the cooperative system between the central government and local governments in the field of disaster management from a legal and institutional perspective and to propose directions for its development. First, the study examines the cooperative system between the central government and local governments as discussed under the Local Autonomy Act. Based on this foundation, the current state of the cooperative system in disaster management is analyzed through the dimensions of control, such as guidance, support, and supervision for local governments, and cooperation, such as the submission of opinions and consultation, as specified in the Framework Act on the Management of Disasters and Safety. The study suggests that control over local governments should be improved by emphasizing legality and minimizing enforcement ambiguities. Furthermore, it recommends establishing a legal framework to institutionalize local government-led submissions of opinions and the operation of cooperation meetings and policy consultative bodies to enhance collaboration between the central and local governments. This study is significant in that it provides a pathway for strengthening the institutional foundation of the disaster management cooperation system, thereby promoting more effective collaboration between the central government and local governments in disaster management.
